BANGKOK: -- The Election Commission (EC) will file a police complaint, accusing former EC secretary-general Phuchong Nutrawong of defaming and insulting the agency, EC specialist Thanit Sriprathet said yesterday.

He said the commission yesterday accepted its legal office’s proposal that a libel suit be launched against Phuchong in accordance with Articles 326 and 328 of the Criminal Code.

In a press interview, Phuchong allegedly accused the election commissioners of only working one day and spending the rest of the week studying, Thanit said. .

He added that Phuchong also allegedly claimed that the EC sent signals to foreign countries to invite them over for overseas excursions.

He said the former secretary-general also told the press that if "he is wrong, then the EC is also wrong as nobody can be trusted when personal interests are involved".

"This could mislead the public into thinking that the EC has vested interests, which can be seen as an insult and defamation," he said.

The EC chairman yesterday assigned the commission’s legal office director to file a police complaint against Phuchong over libel.

The EC dismissed Phuchong in December for allegedly failing his performance evaluation and frequently delaying the completion of his work. Phuchong appealed the dismissal.

Thanit said the EC did not take Phuchong’s appeal into consideration, adding that the office has 90 days to decide on the matter.

Police complaint for "defaming and insulting the agency" - 21st century barbarism.

. The picture shown was the guy emotional after being sacked and his staff giving him a rousing fair well.. Seemingly he was liked by the rank and file of the EC.

PS: I know for a fact that many of the upper management at the EC do indeed take study time during working hours (paid) I have an acquaintance who did his PHD Thursday and Friday for a year and a half!

Cough syrup...

Libel is defamation of a person. Lawsuits like this should be thrown out.

Well, Thailand has a rather strict defamation law and many like to use it, including criminal fugitives.
