Possible termination from work

hi.

i am a foreigner on a work permit here. been here for about 3.5 yrs . recently ,my company is going on a cost cutting drive and i see that i may be possibly next ( going to a meeting in 30 mins time ! ...lol )

so, my question is, which 'agreement' is valid,

i signed a 'contract of employment' when i came here, but i cannot read it now as i am i at work.

if i am not wrong, the standard notice of termination is ONE MONTH pay for me to bugger off in that contract.

but what i see on the internet now is based on years of service. e.g. after 1 yr = x month, 2 yr = y month ...and so on. ( this apply to locals only )

so , i am not sure which 'agreement' is valid.

any advise ?

You have the same rights as a Thai under the Labour Protection Act B.E. 2541 (1998) ,

You are entitled to 30 days notice of termination and the severance pay called out in it.

Our company is going through similar downsizing so a few of our guys engaged a lawyer who also pointed out that although our contracts ran from year to year, when the contract was extended past the first year, we became "permanent employees" for purposes of calculating severance pay.

So far, the company has been good about paying what's called for in the rules.

You are entitled to 1 months notice or 1 months pay in lieu. If you have been employed over 3 years (check the start date on your work permit) you are entitled to an additional 180 days severence pay.

How does severance pay etc work when your notice period is 3 months? Is that factored in or kept separate so a termination for an employee who has worked full-time between 1-3 years would be entitled to 3 months notice plus 3 months severance?
