Short Overstay

Featured Replies

A friend has a 90 visa that is dated 17th April. He has a flight back to the UK leaving in the early hours of 19th April. Apparently he asked IMM what are the consequences and they just said 100thb fine ... that is it?? Thanks

  • A 2 day overstay will be 1,000 baht.
  • As long as he doesn't get caught during the 2 days there will be no other consequences.

p.s. Immigration, at the airport, do not charge for a 1 day overstay so if he exists before midnight on the 18th it would be 0 baht.

The fine for overstay is 500 Bht/day. Two days overstay amounts to 1000 Bht.

There will be no other consequences..

In case of arrest and prosecution, foreigners who overstay less than one year will face a ban of five years and ten years for overstaying more than a year.

A 100 baht fine that's cheap.

Why doesn't he just get an extension for 1900 baht and save all the potential hassles.

That is it thanks.

You get 1 day grace at the airport anyway. So 500 baht max. There's no way he'll be in any kind of trouble if he's caught. Only foreigners with over 90 days get banned. Some people on here are such drama queens.

It is not entirely clear what a "90 visa" is, but it is likely he does not qualify for an extension. If so, and he applied for one, we would likely receive 7 days to leave the country. However, because of Songkran holidays and then a weekend, it seems impossible to apply between April 13-17 which is what he would need to do. If he cannot find a good alternative, a deliberate overstay may be a rational choice.

Nope, 1 day is free, 2 days is 1,000 Baht (you have to pay for the 1st day).

The new legislation is somewhat unclear about penalties (in addition to the fine) for under 90 day overstay when leaving at the airport (i.e. giving yourself up).

In the circumstances I would play it safe, either with a flight change or a border hop for another 15/30 day stamp.

I would say the rules are pretty clear about overstays of under 90 days if you give yourself up.

I think the info I posted makes it clear that if you go the airport you will not be banned for an overstay that is less than 90 days.

Thanks Joe ... no problem unless he gets in a situation where he needs to show his passport to the BIB during overstay period.
