Getting a Work Permit on Non O Visa (Marriage)

Hi,

I currently have a 90 day Non O visa (marriage) which expires the beginning of April. Before it expires, I will extend it for another 60 days. My question is, can that Non O be used to get a work permit or do I need to leave the country and get a Non B visa?

You can get a work permit with a non-o visa based upon marriage. A copy of your marriage certificate needs to be included when the application is done.

Yes you can get the 60 day extension to visit your wife. She will need to be with you when you apply.

You may be able to if your name appears on their birth certificates, you have a copy of their Tabian Ban and you have the children with you when apply.

You can. Non o is easier than a non b for pretty much everything.

Are you sure that your name appears on a Tabian Baan ?

You can obtain a single entry "O" visa from Savannakhet with the birth certificates and the children's Tabian Baan. A mutiple entry "O" visa might be obtained if you apply together with the children's mother and the children. No finances need be shown.

If you legitimise your parenthood a 12 month extension of stay could be obtained from immigration.

Yes I am. I have my own Yellow Tambian Ban. And they use the number on that as an Thai ID on my drivers license and other official documents.

I have been living in Thailand for 12 years on Non-B work visas but it would be a lot easier just to get a Non-O and skip all the documentation that the Non-B requires.

By the way I just came back from a successful trip for a new Non-B visa. Can that changed to a Non-O at immigration in Amnatcharoen or do I have to take a new trip to Savannakhet?

Have a "wife" but we are not married yet due to the extensive paperwork needed from Denmark. It is a real hassle because I don't have an address in Denmark anymore but I am going to start the process now. Make everything a lot easier and secures that the children can be Danish nationals.

Visa classes cannot be changed.

Sometimes immigration will agree to change the reason for an extension of stay but it would seem you do not have an extension and do not qualify for an extension based on marriage or on the basis of being the legitimate parent of a Thai child.

If you can resolve the marriage issue then you will have other visa/extension options.

It is a non-o visa and/or an extension of stay based upon being the parent of a Thai not for supporting them. That is why you have to be the legal father of your children to get a one year extension of stay.

I guess I will start going to our local Tesaban here in Roi-Et and ask if they are willing to do the paperwork for me. Luckily I have been staying here for about 6 years and know quite a few of the influential people in the Tesaban. I will post about my experience later.

Hi Kimpil I went to Laos last week to get a non O visa for my kids ( not yet married ). I took photocopies of my kids birth certs and copy of blue book. In and out in 15 minutes.

Last Thursday I went with my "wife" and kids to our Tesaban office to get registered as the legal father of my three children. They were as always very nice and we were immediately guided to the head of department since he is the only one who can sign the documents. He was very helpful although I am not sure he quite understood the documents I needed. It didn't help that my wife kept on talking about us going to Denmark with the children. I tried to show him the passage from Isaan Lawyers but he just said "No, can not do for Farang"

I also told him that I needed this paper so I can stay in Thailand as the legal father of my children. As I said he was really helpful and I ended up getting two documents, one for taking the kids to Denmark and one should be stating me as the legal father. I don't know if this document is sufficient or correct since I can't read Thai. My wife said it is OK but I am a bit skeptical since all three children are on the same document.

Your children are, I believe, too young for the Tessabaan / Amphur to have agreed to legitimise your parenthood.

Maybe you are correct - but age wasn't an issue. The oldest will be 7 tomorrow by the way. It is stated in other topics on TV and by the Isaan Lawyers that kids as young as 4 and even babies sometimes are accepted by the amphur. I will contact a Thai friend who is a lawyer to get the document checked.
