Well a friend from holland he has been here in Thailand 7 months.Overstayed 5.

Has money allot but fell in love yeah yeah i know..she had a thai boyfriend he then got the attitude of f this place f that i dont care if i ever get banned i am moving to philipines.He flew to philipines yesterday.On leaving thailand he paid 20 thousand baht.Immigration asked him why overstayed and so forth.This dutch guy is very polite and speaks nice with Thai people.Anyway he recieved no stamp in Passport he was expecting a 1 year ban.He asked the IO "i am banned for one year" immigration said no ban can comeback anytime.He should of been banned for 1 year right?

Since we have had no reports of anybody being banned yet I suspect immigration may not be strictly enforcing the rules yet. Perhaps a longer overstay or being a repeat offender will trigger the banning at this time.

Yes ubonjoe i think you are right.I guess at the end of the day it is still up to the immigration officer at the time.Some are more forgiving then others

He may of then got lucky as the rule took effect March 20. But then again just because they did not stamp his passport as banned it does not mean his details are in the computer and noted as such. He needs to be aware of such.

If you count on staying 5 years then the elite visa is almost as expensive. (but legal)

Sure -- but the Elite is paid up-front lump-sum and the 89-day extension version is pay as you go and as necessary.

Both timely reports come from someone that has been here a short time, overstayed twice, and appears in every overstay thread criticising anti overstay opinions. I did/do expect a honeymoon period and hope IO's have certain ongoing discretion, but until there is a report from a more credible person, without a clear agenda, I will reserve judgement on the enforcement of the new rules

Not sure where you found that image but it appears to be a normal entry stamp with banned added on to it by editing it with Photoshop or some other editing software.

A real banned stamp would be larger with a good deal more info on it and would be in Thai.

I must admit to being surprised by this report. It seems the IOs are being allowed to use their judgment on who to ban and who not. I thought the rules would be inflexible. I actually wonder now if the rules are only normally intended to target specific nationalities.

Wonder if he got a receipt for his 20g being polite he might ot have asked for one..

Or maybe "surrendering" and getting a ban means being processed through court. So the airport could be an exception if the IOs do not want to bother with the court hassle and the passenger is ready to go.

You know...English...Thai. Maybe they meant surrendering and being prosecuted or arrested and being prosecuted.
