Just a question, I work and live in Thai, my new company did arrange my work permit for me, but have not seen documents or prove of it yet.

What if they scam me and they did not. Means my last visa until today will be an overstay right ?

And to find out if they did or not, could I go to the ministry of Labor and check it if I am registered?

Anyone with experience with this? With an overstay in my passport go to a other job who really want to provide a Work permit possible?

Or am I just Doomed and get a ban.

I would like to know as well that if you turn yourself in with an overstay, Do you get a change to explane why you got this?

Is there a lawyer or prove needed to prove not guilty, like its really not your mistake, caused by a scam. ?

Please help me out with some information.

Whether you have a work permit or not you will be on overstay when your current stamp expires. You need to get an extension done to stay legal. You need answers from your company fast.

The labor ministry has nothing to do with your permit to stay in the country. They only issue work permits. If you had a work permit you would have the book to prove it.

Your permit to stay would be stamped in your passport by immigration when you got an extension based upon working. In order to get that you would need a work permit.

Look in your passport to see what your current permit to stay date is from an extension or in the worst case the one shown on your last entry stamp.

Thanks for the reply, this generates the next question, Can I own a work permit while have an overstay? I mean will there go ring some bells at the ministry of labor ?

After the work permit is issued the labor ministry would not be a aware of what your permit to stay is until you apply for a renewal of it. The work permit is not tied to your permit to stay.

If you are on an overstay you need to get that sorted out yourself. If on overstay you are not allowed to work.

I might consider to get a lawyer because I feel like getting scammed at the moment.

This company's excuse was they hold my passport because they did pay for my 1 year visa and thats true, so I don't or can't run off.

But yeah I hear you.... wrong.

Now I get a new job opportunity right at the ministry of education because my mother in law is director there, so good for me, you know how it works right.

And they want to provide wp. and good salary, I'v been to meetings there and agreed to all condition's, But its just to get rid or out from this current company.

But if they scammed me and did not apply a work permit or whatever I'm afraid to get in trouble. Besides before I signed a contract of this company, the lawyer get all documents needed to apply for a year visa I did sign all documents needed, and the company would arrange the emigration meeting throu this company lawyer. I was arranged so they said.

Your employer has no right to hold your passport. You have to have it available if you are asked for it by the police or immigration.

You need to get your passport back to find out what you have now.

It seems you are married to a Thai. You should get your passport back, leave and get a non-o visa based upon marriage that would allow you to get a work permit and work.
