Court rules Thammasat lecturer Somsak Jeamteerasakul dismissal unlawful

image-3.jpeg

BANGKOK: -- The Central Administrative Court today (Monday) ordered the revocation of the order of Thammasat University expelling lecturer Somsak Jeamteerasakul from the university on the ground that the order was unlawful.

The court also ordered the university to withdraw its ruling rejecting the lecturer’s appeal against his dismissal.

The outspoken history lecturer lodged a complaint with the Central Administrative Court accusing the rector of Thammasat University and the civil service commission of the higher education institute for dismissing him from teaching service at Thammasat University on February 23, 2015.

On May 16, 2014 Somsak submitted a request to the university for a one-year break to conduct a research on history and social philosophy starting from August 1, 2014 until July 31, 2015. However, the vice rector for technical affairs revoked Somsak’s request some time between December 18, 2014 and January 27, 2015.

The court pointed out that Somsak was not notified with the vice rector’s ruling rejecting his request for a break in teaching. The court also ruled that the lecturer’s conduct for not returning to teach could not be interpreted as deliberate dereliction of duty.

For that matter, the court ruled that the university’s order dismissing Somsak from the university was unlawful.
