Academics say Referendum Act violates public freedom

BANGKOK, 13 May 2016 (NNT) - Deputy Prime Minister Wissanu Krea-ngam has said the referendum on the draft charter will be carried out under the Referendum Act, which has come under fire from a group of academics.


A group of academics will file a complaint at the Office of the Ombudsman after they decided that the Referendum Act violates public freedoms. Dr. Wissanu said the law will remain effective for the time being, until the Constitutional Court rules that it infringes on the freedom of expression.

He added that unless there are any changes before August 7, when the referendum on the draft charter is held, everyone must abide by the Referendum Act.

I do not believe that the interim charter currently in effect grants any rights of freedom of speech/expression/gathering, etc., to the people.

Further, the Constitutional Court is not granted any ability to review NLA-passed legislation.

In the case where the question concerning the decision under paragraph one arises in the affairs of the National Legislative Assembly, it shall be decided by the National Legislative Assembly. If the question does not arise in the affairs of the National Legislative Assembly, the National Council for Peace and Order, the Council of Ministers, the Supreme Court or the Supreme Administrative Court may request the Constitutional Court to make decision thereon, but the request of the Supreme Court or the Supreme Administrative Court shall be approved by the plenary session of the Supreme Court or the Supreme Administrative Court and on the matter related to the trial and adjudication of cases.

That would be the same Court that ruled that the NCPO's Interim Charter was legal and binding on the Thai people after the NCPO abolished the 2007 Constitution. Therefore, NCPO was entitled to immunity from charges of treason in its overthrow of the government under the provisions of the 2007 Constitution and from the still current Penal Code.

For a Court whose origins were from coup d'etat appointments, don't expect decisions that would run counter to its benefactors.

I suspect those academics will be wisked away to some army barracks for 3 days of attitude adjustment.

If you go onto YouTube and have a look at the videos of FCCT events, you will find plenty of Thais with both intellect and a superb command of English.

Couldn't get a visa to visit USA? Does have it's problems, but lack of freedom of speech isn't one of them.

Unfortunately it has been left to the academics to once again voice their concern against this referendum just like they had to do against the Thaksin Shinawatra government, it would be a pleasant change if the Thai media grew some goolies and gave them a hand in opposing this charter, the worst that can happen is under section 44 you can be all put away for 10years, now that is really human rights abuse , but it doesn't seem to worry the academic's ..............................coffee1.gif .
