Non - B visa : cancellation work permit

Featured Replies

Hi There,

really specific situation, I didn't find a similar one on here immediately...

So I am working at this company, I got my single entry non-B visa in Singapore and it is valid until the 19th of July.

They have applied for my work permit, which is still at the labor office, I haven't picked it up yet.

I am now leaving my job for a new one in a couple of days.

My current employer will cancel my work permit, am I allowed to stay in Thailand after that?

This situation is different because I haven't picked up my work permit yet.

My current employer told me they were going to cancel my Visa, there is no way that they can do this right? Or does the visa get canceled when they cancel my work permit regardless whether I have picked it up or not?

If I leave the country in a couple of weeks to get my new non-B, will they count that as an overstay? Because the date on my Visa says it expires the 19th of July, which is only in a couple of weeks.

Thanks in advance!

Your visa cannot be canceled.

Are you sure you wrote the date right in your post.

The visas expiration date is not important. The admitted until date on your entry stamp is what matters.

The stamp on my visa only states the day I entered Thailand, there s no expiration date on the non-B... 21st of April 2016 was my date of entry, so it says "used 21st of April2016" , no expiration date on my departure card either.... What does that mean?

If they take me to Chang wattana with it, can they cancel it?

I had to use the non-B visa and enter Thailand before the 19th of July

Is it possible they forgot to stamp me?

The stamp is not put on the visa, It is probably on an joining page if there was space for it. It has the date of entry and and the admitted until date on it. As long as you leave before 90 days from the date you entered the country you will not be a problem.

They will not cancel your permit to stay. How would they take you to CW if didn't want to go.

You are right, it says 19th of July! And they might refuse to pay me...

So if I go, it could get canceled?

They do not cancel entries from visas. Only if you had an extension of stay would they cancel a permit to stay from it.

Okay thanks! So if we go to CW tomorrow, they won t be able to do anything about it?

Who is taking you to Chaeng Wattana?

No one can force or take you anywhere you do not want to go.

Your visa does have a expiry date marked as the "Enter before " date on the whole page visa sticker.

The stamp placed in your passport when you arrived is not a "visa" The stamp gives two dates. The date you arrived and the date by which you should leave. The same stamp can also be found on the departure card.

Your stay in Thailand cannot be "cancelled".

If your ex employer incurred costs in securing your visa/ work permit they may seek to have you repay those costs but that is nothing to do with your "visa or permission to stay in Thailand which cannot be 'cancelled'

I think they are confusing extensions issued by immigration and visa entries. They are accustomed to extensions being canceled when the job ends. An entry from a visa cannot be canceled.

Okay, I will tell them tomorrow! Thank you so so much all of you, this was so helpful, I can't properly express it!!! You are lifesavers! :-)

Just keep your passport in your pocket and smile sweetly.

I've always worked on 'Visa' is yours, 'Extension' is theirs.

Spread the word and the meanings.

Hi all,

thanks for the help! But tiny follow-up question, if they cancel my work permit, can they still only cancel the extension?

Or does getting the actual work permit involve an extension/getting a new stamp? Which means that after cancelling it they will be able to cancel my VISA?

Or does getting a work permit change nothing for your VISA? Will it still be valid until the 19th of July?

In order to get an extension based upon working requires a work permit. It does seem you will be getting to that point. An employer cannot cancel an extension.

Your visa is already not valid for anything since it has been used already. All you have is the permit to stay it allowed.
