Who should I talk to about internet laws in Thailand?

I was thinking about making a mobile app and web site about Thailand that would have a lot of adult language on in it. No nudity or anything or anything related to Thai politics, more like a dating thing. Anyone know who I can check with to make sure I'm not breaking any local laws by doing so? Thanks.

This 'App' with a lot of "Adult language" would almost certainly fall foul of the Computer Crime Act or the Cyber Crime legislation

Where in that doc are you seeing anything about language or adult content? You mean it's in violation by 'falling foul' right?

I just provided some information . You can do what you like with that information but I suggest you get an Adult to help you read and understand what it says before

you put foul "app" up !

To be clear, I'm looking for a reference for someone familiar with Thai law related to this. Not looking for your two cents or internet findings. Really appreciate it.

If you want Legal Advice about Thai law engage a Thai lawyer.

OK ?

Can you get off my thread man? It should be pretty clear I'm looking for a lawyer.

I am also not a lawyer but:

Why do people often act like idiots when people ask a question? No idea....

Having lived here for over 20 years it would seem to me that nudity is a big issue, English profanity is often on TV and radio. It seems to be no issue at all.

What other adult content are you thinking of?

There are English speaking lawyers who advertise on Thaivisa , ask one of them . I doubt there are many readers/commenters on this site who are lawyers ;

hence the personal opinions expressed . It sound like you are intending something of a chat site ; people can communicate in " lavatory " language .

Adult language translated to and from Thai is the only adult content. Like a Men's Health Magazine would have profanity, sexually descriptive and medical language. I would assume myself it's not an issue, just looking for confirmation. Thanks.

The best thing to do is host the website outside of Thailand and administer it through a VPN connection. No legal issues to deal with. whistling.gif

Who to speak to about Thai laws?

Would that be

(a) your Gardener

( b )your maid, or

( c ) your lawyer.

Yes I can see how that would be a hard question to answer

I'm no lawyer, but unless you are putting this app/website up on your own server which I suspect you are not, the hosting service that you use should sanitise anything you put up on their servers. If it is in breach of ToS they will simply shut you down/advise you before anything gets published.

That failing, host the app/website outside of Thailand. In this case if the Thai authorities deem it inappropriate they will simply block access within Thailand via the gateway. If it gets to that point you can go down the proxy access route but that just complicates things.

Does any of the alleged content involve billed waddling creatures or others descended from the Siberian Hamster? If not you should be OK to go ahead, just avoid any religious or sexual preferences.

They are actively monitoring anything that "rocks the boat". Many adult sites are now difficult to access without a proxy.

I am not sure what is happening yet with the "Single gateway" which would enable, AFAIK, monitoring of traffic. Does anybody know more? It has gone suspiciously quiet.

In my experience of an internet issue in Malaysia---most regular Lawyers don't understand much about internet law (revenge porn, nudity etc.). The USA is the leader for that stuff. In the end, I found only ONE lawyer in all of KL who could tell me about internet laws. I appreciate that Malaysia may have different laws to LOS, but I reckon that most Thai lawyers deal only with regular-type stuff, so you may need to dig around.

I did use the on-line free advice lawyer here once, for something unrelated. I was not aware that the service had ceased. Is that so?

Yeah that thread is closed. I'd rather just get a reference for a lawyer specializing in this field to discuss with him in private. In the US, we had lawyers in the office at some of our larger development shops, as you mentioned though they're hard to come across in Thailand based. Thanks.

I can not answer your question.

However ....no matter how legal you try to be the various authorities will always make it difficult for you to operate legally while you are always subjected to their interpretations of the law and regulations and in the end you are doing something wrong to their way of thinking.

After you open your business then you will learn what I mean.

Cheers
