Former EC chairman to serve two years in jail with no suspended sentence



BANGKOK: -- The Supreme Court today sentenced a former Election Commission (EC) chairman and a former commissioner to two years in prison and bannned them from elections for 10 years.

The two convicted former commissioners are Pol Gen Wassana Permlarp, and Mr Parinya Narkchatree.

Both appeared at the court room to hear the final ruling and their petitions for relief of their jail sentence.

But their petitions for suspended imprisonment were also rejected by the high court with reason that as they were appointed to the prestigious positions because they were entrusted with faith that they could stay neutral in politics, but they behaved on the contrary and made unfair judgement that had contributed to the benefit of the defunct Thai Rak Thai Party.

The high court ruled that the requested suspension of sentence was unaccepted and upheld two earlier rulings by the Criminal Court and the Appeals Court that handed down two years imprisonment sentences and 10- year ban of elections.

Both claimed they had done a great deal of good deeds to the country that earned them in the prestigious positions as reason for suspended sentence.

The case of election frauds was brought against three former EC commissioners by Suthep Thaugsuban, former secretary-general of the Democrat Party for alleged dereliction of duty for failing to investigate a now-defunct predecessor of the Pheu Thai Party.

But former commissioner facing the court case Mr Veerachai Naewboonnian had died of sickness.

Suthep filed complaint with the EC accusing Thai Rak Thai Party of hiring the Paendin Thai Party and Pattana Chart Thai Party to field candidates for the April 2, 2006, election.

He named the three former commissioners as defendants for not investigating his complaint filed under the EC’s regulations.

The defendants denied the charges.

According to The Nation, the Criminal Court in September 2006 found the three defendants guilty as charged and sentenced them to two years in jail each and banned them from elections for 10 years.

The Appeals Court in May 2008 upheld the ruling. During the appeal to the Supreme Court, Veerachai died.

2 years jail and banned from elections for 10 years, not so harsh. They will have been out of jail for many years and their 10 year ban will be well expired before the next election.

But more importantly, what about the 50 million + who have commited no crimes and have been banned from elections for 2 years to date, with no "release" date given?

Suthep strikes again. Is Suthep in charge of Thailand at the moment? Maybe I'm paranoid but everyone who crosses paths with him seems to be in deep dodo. The abbot of Wat Dhammakaya, the TV anchor man who's news was in Suthep's eyes too bias towards Thaksin's pheu Thai party, jataporn defaming Abhisit gets a suspended sentence, there's more, that's just the latest. I remember a few years back before the recent coup, the absolute hatred for this man by the people I talked to, now he's running the place, oh how we yearn for the winds of change. They want to observe so people know they are being watched and vote as instructed.

TRT were found guilty of breaking the law in hiring parties to contest elections where they would've been the only party and had to contend with the single candidate rules. These guys have been found guilty of failing to do their duty and impartially investigate when it was reported to them. A bit like Tharit inventing a new definition of perjury and refusing to investigate Yingluck the day she was elected.

But, there again, just business as normal for politicians all over the world.

He is just a tool, and not the sharpest one in the box either. When the real power decides he has served his purpose he may be allowed to retire quietly and enjoy his plunder or he may not, but his influence will not continue. He is no Prem.
