New law to give more teeth to ALRO to reclaim Sor Por Kor land from illegal occupants

BANGKOK: -- The new land law to resolve the problem of illegal land occupation in Sor Por Kor land now pending with the Council of State will give more powers to the Agricultural Land Reform Office claim back the land from illegal occupants, said ALRO secretary-general Mr Sansern Atjudmanas on Thursday.

He pointed out that the new law which he expected to be submitted soon to the cabinet for approval is similar to Section 44 of the interim charter in a way that it empowers ALRO officials to summon occupants of Sor Por Kor land to explain how they acquired the land in question and whether they have any official documents to prove their legal occupation.

The new law also sets out measures to prevent and resolve Sor Por Kor land problem in the long run. In the case that occupation of the land has changed hands and there is attempt to cover up the deal from officials, the law will empower the so-called agricultural land reform committee to forefeit the occupation right of the first recipient of the Sor Por Kor land which will invalidate the right of the second or third recipient, explained Mr Sansern.

Section 44 is certainly getting abused. Just imagine what a competent elected PM could do with the same power.

Maybe eradicate the military and solve most of the long standing issues with one decision

Do you consider THIS to be abuse of Section 44? And why rule out Yingluk?

This land business is almost unreal.

Many people have sold and resold land which was originally sold a person.

This has been happening for generations, it is totally wrong for the current, so called, government to change the rules now.

I agree in the case of large holdings, which actually seem to be the issue, because some of these probably have been abused due to the economics of some business or other, but in crtain parts of the country, most farming land is Sor Por Kor as the government and or local officials have been negligent in surveying.

so because they have been doing it for years they should be left to continue, what a joke, thats like saying they have been killing anyone that gets in their way for years so should still be able to do it too. The fact it has been done illegally cancels out any owner from actually owning it, if they had bothered to actually chase up all the past documents etc they would realize its illegal but it is easier for them to ignore it. What they need to do is arrest and seize any property owned by the original owner and anyone in the govt that helped them, until they start arresting and charging the govt officials that allow this to happen it will not stop. Being Thailand though and the fact that mpst of those involved are high up face then comes into it and this is what stops them taking action, they know they are guilty but do not follow it through and lock up the ones that started it

The Sor Por Kor deeds seems to be greatly abused. They're essentially blank checks for land grabs and government corruption. Why not eliminate them completely as there seems little government review over the accuracy of what lands they're being used. Require all land deeds to be legally surveyed and filed for review against potential deed conflicts.
