Overstay stamp in passport

Recommended Posts

Hi all, I am currently having my second visa extension processed. My current extension expires in Wednesday. Am I correct in assuming that if my application is not granted by Wednesday I will infact be an overstay and my passport would be stamped accordingly? What will the impact on future movements in and out of the Kingdom if this was to occur?

I just renewed my passport as the old one had only a few month before it expired and I understand one can't get a 1 year visa extension with a passport with only a few months validity. I would prefer not to have an overstay stamp in my new passport.

Any advice or tips would be appreciated.

Cheers.

If you applied for an extension of stay (visas are not extended) and paid the 1900 baht fee you would be granted 7 days to leave the country if the application was not approved.

What type of extension have you applied for or plan on applying for.

Thanks Joe, I have a non B and my extension of stay first time was for 1 year applying for another year and my work permit is already extended.

It seems you are probably on a under consideration stamp with a 30 day report back date shown on it. It is is unlikely your extension will be disapproved.

A under consideration stamp allows you to stay until your extension is approved or disapproved. If disapproved you would be given 7 days to leave the country.

Thanks again Joe, you are the font of knowledge on these matters. That eases my mind some what.

We got caught time wise by requests for information not required first time. I thought the second one would be easier than the first but apparently not so.

Immigration procedures never stand still

As predicted ended up with the under consideration stamp which creates another problem. I am required to report in person on October 11th but I am scheduled to be in Melbourne at that time. Can this date be brought forward?

What happens if I go to the consulate in Melbourne and get a Multi B visa, will my work permit still be valid?

Thanks for further guidance.

Applications are often approved prior to the report back date. How long before the 11th are you starting your trip?

You probably will not be able to get a multiple entry non-b visa at the consulate in Melbourne. Recent changes are such that only the embassy or the consulate in Sydney can do them. You should be able to get a single entry visa with the required documents. Your work permit would still be valid.

Thanks Joe, I would like to fly out on Friday Sept. 30. The whole thing is a little frustrating.

I don't think it will be done by the 30th. It may be frustrating but it is normal for them to put extensions based upon working under consideration.

The best thing to do would be to change your schedule and be back by the 11th.

You will need a re-entry permit for the under consideration period.

Thanks Joe, yes I thought about flying back on 9 and about needing another re-entry permit as my old one expired with my extension.

Strange how the first extension was not done under consideration just granted, and this time has more documentation requirements from the company than previous.

The Immigration officers are all very polite, but the waiting times are extensive.

Not true. No 7 days given in my case !!!

I had to report on Nov 16, 2016 for my extension on my NON-O based on Thai wife. My passport was stamped and I had to leave the same day. I was even picked up by immigration police at Chaeng Wattana and escorted to Suvarnabhumi Airport. I had to make a reservation to Amsterdam for the first available DIRECT flight when I was hold up at the Government Complex at Chaeng Wattana...

Why was your extension application not approved?

I can see they did the stamp for it but changed it to the same day you were at immigration.

I think there may be more to the story than just a denied application.

It is written in the police order that you get 7 days to leave if your application is denied.

There was absolutely no reason for it... Now I am back in Thailand. My wife even travelled to Europe with all our papers on a emergency visa. I had to get a visa from Holland which was denied because I was not living in Holland nor did have any income in Holland in my life.

On my way back, I went to Singapore, had my 60 days there (tourist)

You say: " It is written in the police order that you get 7 days to leave if your application is denied. "

This is NOT true. It is just at the discretion of the immigration officer...

Here is what is written in  Police Order 327/2557  basis for extension of stay.

Quote

4. In case where an applying alien does not meet the full qualification stipulated by the criteria herein, the alien must be notified of the non-permission order and must depart from the Kingdom within seven days from the date on which the permitted period has lapsed.

Discussion can continue in the topic you posted that I have moved to this forum.
