1 Day Overstay...

I am out of the country for a month, cant get a ticket until the day after my extended tourist visa expire. Would 1 day overstay be a problem as I am applying for a new tourist visa just a couple weeks later of the departure?

Shouldn't be a problem, if you're leaving by air AFAIK the first day is still gratis (still get the overstay stamp though).

A single, one-day overstay shouldn't cause trouble getting a visa but I certainly wouldn't make a habit of overstaying in the current climate.

I believe Crossy is correct, however if you got caught before getting to the airport then I believe you might risk arrest. Anyone else got any thoughts on this?

You are quite correct, however the chances of being apprehended are very small unless you make a habit of frequenting locations liable to be raided by the Boys in Brown or of crawling home at 3AM (3 hours after your permit to stay expired). Now that would be a first, nicked for overstaying by 3 hours :o

I would not advise any overstay. Although the chance of arrest is small it is there. But in your case there seems to be even more important reasons as you seem to be planning an early return that the overstay stamp in your passport may well cause a Consulate to take a second look at any visa application. Although it has not been a major factor in the past we just do not know how it will be treated in the future. If I were from a country that is allowed 30 day entry without visa I believe I would make a border run during the last week of my current visa stay to obtain a new 30 day stamp.

But I admit to being very conservative on this issue.

For the first year or so that I stayed in BKK full time I pretty much was ignorant of the law...I would go to the airport 50 or 60 days overdue and just pay the fine (at that time... during the pre and just intro-Taksin period it was not that much of a fine). Also, at that time I was living at The Oriental and I never carried my passport with me so I felt safe.

If I were from a country that is allowed 30 day entry without visa I believe I would make a border run during the last week of my current visa stay to obtain a new 30 day stamp.

Maybe worth going to immigration first and applying for a one day extension? I'd think there'd be a decent chance he'd get at least that, maybe 7 or 10 days even. Especially if he brings his airline ticket with him.

This is really the most sensible suggestion. Immigration will bend over backwards to help before the overstay line is crossed. Thereafter can be problematic.

(Fancy being the first 24 hour overstayer to miss your flight out because you are locked up in Immigration Prison?)

:D:D He,he - Corkscrew, you certainly put a whole new spin on the "typical over-stayer" as he is often pictured here on Thaivisa! :D Now I start to wonder whether a LOT of over-stayers are staying at the Oriental in order to avoid detection!? :D
