Apologies if this is not the right place to post this but there doesn't appear to be a discussion thread for non Thai deaths and inheritance laws but it may be that I'm new and unfamiliar with the site.

 

Please could anyone advise? 

 

Hi, a son dies in Thailand, is married to a Thai but has no children and no will.  He works for part of the year in Australia.   He has properties, business and bank accounts in Thailand and also in Australia.  The wife applies to an Australian court for full entitlement to all his Australian assets.  Shouldn't she be claiming everyting from Thailand?  I ask because this is happening and we think possibly it is because it circumvents the parental rights to 50% of their son's estate.  What can be done about it?  Thank you kindly.

Sorry to hear that it was obviously somebody you knew very well.

 

         Let's assume it's you son ( sorry, why else would you open an account here and ask such a heartbreaking question). The topic is so complex that you won't get the right answers by only having a bit of information.

 

        What about the son's parents and relatives? Generally speaking, they'd also have a right to receive something. What really amazes me is that the Thai woman already got in touch with the Australian court?

 

        The best advice for your problem is to have an appointment with a lawyer in Australia. 

 

           Please don't waste more time and seek professional help before it's too late. There're so many factors to consider, like how long they've been married, what the deceased man's relatives think about it and what the legal point of the assets in Australia are.

 

 I don't think that she's got any legal rights to receive all and everything in Australia and I don't think that one buck came from her. 

 

           I truly wish you the best. Sorry to say that, but when it comes to money, all friend and relationships seem to end.
