16 years overstay...and its not me, for real.

I’m curious about this because I know someone in this situation: if someone has a long term overstay (16 years) but no criminal record, and they simply show up at the airport without having been stopped beforehand, can they automatically pay the fine, get the stamp, and receive the ban without further consequences? Or is there a risk of being arrested and having to go through the whole official process, starting at Suan Phlu? Thanks.

Fine capped at B20k I think............ plus 10 year ban.

However, if you're 'caught' as opposed to being seen to 'leave' you could/would be jailed...I think.

What you wrote about the fine is correct, as is the information regarding the ban. His fear is that he might also be arrested at airport immigration when leaving Bangkok.

Yes....... if, as I say, he is just caught by chance, there is a much greater certainty he could end in prison.

I wonder if going to an IO and fessing up might be a better route? Take his air ticket, show he is leaving, throw himself at their mercy???? They might issue a letter for the airport to let him leave with no further hassle??....Obvs he still be fined and receive a ban.....but it takes a lot of stress out of the situation.

I meant whether immigration control at the airport might arrest him anyway at passport check; normally, you pay the fine, get your passport stamped, receive a ban, and that’s the end of it. But with 16 years... Going to the IO: a solution that, in my opinion, would be feasible and reasonable for a short overstay... but with 16 years, honestly, I wouldn't know.

No.....and I guess no one does know until it happens...... it might depend on the officials that deal with it as opposed to laws and policies.......if they've had a bad day......boom!!

There was a report in the news in the last few months that 2 people trying to leave after a long overstay were arrrested, this was in Bangkok, though the report never said why, it could have been that there was an arrest warrent out

If you are on a long overstay do NOT visit local Immigration, you would be an illegal immigrant and they would be duty bound to arrest you.

I would get PP renewed, if not current, show up at airport with 20k & lawyer, while turning yourself into IMM there.

Or, ask lawyer to ask at your local Imm office, if can turn self in there, with 20k, maybe give you the standard 7 day to leave stamp (of so I read in some cases) with your 10 yr ban. Imm office dependent, obviously.

He has both a new passport and the money to pay for the ticket and the fine.

His passport will not be the same as 16 years ago so if it is very recent it won't have any via stamps in it? 🤫

I saw it when i lend him some money and there are no stamps in it.

I don't know exactly when he renewed it, but it has undoubtedly been more than three years.

Yep, they just have a ticket out, have 20K baht in CASH take BOTH passports (the old one with the original entry stamp and the new blank one) show up to stamp out, get taken to the overstay counter, pay the fine, take the mandatory 10 year ban and wing their way out

Absolutely worst option. At the airport, they let you pay the fine and leave because you are leaving at that moment. They can resolve everything. If you go to an immigration office, you're still on overstay, and you cannot leave. Therefore the only option they have is to arrest you.

I know its not any of our business, but I am wondering why he wants to return after 16 years in Country. You have had some good (and bad) advice here - I lean on going to the Airport with a lawyer and turn yourself in to Immigration, I think its on the 2d floor departure terminal(?)

I knew an Oil Tanker crewman that got off his ship in 1972, he departed in 1996, paid the fine was blacklisted three years, came back with new passport and is still living happily in Pattaya. When Judge asked him "How did you get here, and where is your passport?" I landed on a ship, with only a Seamans Z Card, no passport" Judge shook his head and just said "Unbelievable" In those days I suppose it was easy to hide in plain site.

Let's just say I've seen too many of those topics (and of crackdowns that supposedly got rid of all those longterm overstayers!) to take them TOO seriously at this point. I mean, 16 years, even Big Joke himself could have caught him back in the day.

Lawyer would be useless and unnecessary.

You don't "turn yourself in" to immigration. You go through the departures process, and as part of that you receive your fine and blacklist. Trying to do anything before that means you're likely to get arrested.
