Comey hasn't any valid or viable defense so there is a vacuum there right from the start.

I suppose the only defense is that he did the right thing. If the shoe were on the other foot Hillary would be all over it. It's a bit like trying to have testimony stricken from the record after the jury has heard it - VERDICT - GUILTY.

Which brings up a very interesting point. Who does Comey report to, and how expansive are the FBI Directorate powers? Reporting structure was changed after 9/11 and Comey now officially reports to the DNI (Director of National Intel - Clapper - who in turn reports to POTUS), but the criticism of this new reporting structure is that Clapper's office is weak and cannot control the now ROGUE Comey. So, maybe we are seeing an FBI director clawing back more power, again more in the vision of J. Edgar Hoover.  (Not sure if Comey likes wearing little girl's underwear yet though...)

 

Similarly, the DOJ and its head, Lynch, could have issued a direct order to the FBI to suppress the letter to Congress, and two things could have happened: 1. Comey could have ignored it, and done it anyway, and furthermore made public that Democrat Lynch had attempted to muzzle him; or 2. Comey could have complied, as he might have been obliged to do from an order from the DOJ, and then Lynch's actions most likely would have been leaked, so that Lynch would look bad for quelling this information anyway.

 

Either way, we are seeing perhaps a new power play by the FBI to assert its national power, including election influencing, in the vacuum created after the new DNI reporting structure.
