Hi Guys,

 

A friend is living and working in thailand, with wife and child (daughter) as dependents. He's soon extending his permission of stay along with dependents. Apparantly his child's passport is expiring mid next year so she won't get a full year extension. Once her extension expires mid next year, is it possible for my friend to not do anything?  and just wait for the end of next year at the time of his yearly extension and then extend for himself and wife and child altogether?  even though the child would be on 5/6 months overstay? So the question is, is it possible to do extension of an overstayed child?

Babies can't be on an overstay. 

 

If the extension ends and the child goes on an overstay the non-o visa entry that they extended would also be lost lost meaning a new one would have to obtained.

The child would have to be taken out of the country to apply for a new non-o visa. Immigration will not do a conversion to a non immigrant visa if a person is on overstay.

If at all possible the best solution would be to get the child a new passport.

 

There is no financial penalty payable for a child aged 14 or under for overstay.

Not strictly true, they can overstay and this will be recorded in their passport, but no penalties or fines will applied to minors who overstay.
