Switching Work Visa Extension of Stay to Retirement Extension

Featured Replies

Greetings,

I posted a related question on this forum some time ago and found out that it may be possible to switch extensions of stay without leaving the country to get a non-immigrant O visa for a retirement extension further on down the line.

EXAMPLE:  Extension of stay and work permit set to expire on November 30. (1) Get letter stating that last day of employment is Nov 30th from employer. (2) Go to immigration office a few days (suggestions?) before the Nov 30th deadline with proof of funds documentation and any other documentation required for retirement extension, (3) If approved, immigration will stamp new retirement-based extension of stay, which begins the day after the Nov 30th deadline - i.e. Dec 1st.

Is my understanding correct? Am I missing anything? Do you need to show up on Nov 30th for any reason? Please advise. Cheers...

Your new extension based upon retirement will start on the date you apply for it since your current extension will be canceled on that day.

Thank you Ubon Joe. Does that mean I have to do it on the 30th - the day my work permit + extension of stay expires? What if something goes wrong on that day?

You can do it before the 30th unless you are concerned with loosing a few days on your extension. They cannot do your new extension until the old one is canceled.

I appreciate your advice Ubonjoe. I have no problem doing it before the 30th. However, I'm wondering about the work permit scenario as it is set to expire on the 30th. Doesn't the new/revised retirement extension have to occur at the same time the work permit is cancelled?

When I did the same they offered a temp extension of one week (local office in Bangkok where employer was located) at cost.
This week gave me the time to apply for the extension of stay based on retirement in my hometown

In my case, I had to cancel my work permit and obtain a letter from the labor department first. On the next day, I went to immigration with the cancellation notice from labor. They then canceled my extension based on employment and issued my new extension, based on retirement, on the same day. The latter of course requires the financial documents to qualify for retirement to be complete and current.

It really does not matter when your work permit is cancelled. That is a separate function from the extension cancellation.

There is a conflict here.  The new extension of stay based on retirement does not allow you to work.  However the still "live" work permit technically allows you to work.

Actually there is no rule that says you cannot work with a an extension based upon retirement. But you would likely not be able to get a work permit. I have seen a couple of posts of people getting a work permit for teaching with one but they had change the reason for their extension to working when their extension expired.
