WP & company requirement with a Non O

Back in August this year, there was this post:  

In it was post #18 from UbonJoe about marriage and WP:

If you have a non-o visa or an extension of stay based upon marriage there would be no requirement for it to be registered company or have 4 Thai employees.

What is required to apply for a work permit would depend upon the office you go to. At one time if married to a Thai it was only 2 Thai employees but the ministerial regulations were changed in 2010. I have not seen the latest regulations since they were not made public or announced other than in the royal gazette.”

 

UJ, would you by any chance have any further details on the above now, regarding applying for a WP when you are married to a Thai?
There is a chance of a job, but the company apparently can’t support a second WP, so I wanted to know if there’s some way I can apply for one,as the other WP holder also has a Thai wife. If it is two Thais (& 1 million Baht?) with a Non O marriage extension, per WP, it would be useful to know.

You say it depends on where the WP is applied for. I take it you're referring to "at the discretion of the issuing officer", to quote a much used phrase, rather than some issued list of employment offices that state either 2 or 4 employess?


Also, is there any requirement for the WP applicant to be a shareholder or director of the company, or is it enough just to be an employee who happens to be married to a Thai who is not involved in the company at all?

At one time it was written in ministerial regulations that only 2 Thai employees was required but sometime in 2010 they changed that. But some offices still allow only 2 employees.

There is no requirement that it be you own company. You can be a paid employee.

Another point that has cropped up on this subject is regarding the Visa type.
If it is still possible to use the marriage option, does the WP holder have to have a Non O based on marriage, or is a Non B acceptable - is it just the proof of marriage that's necessary?

Only proof of marriage is required to apply for the work permit. Marriage certificate and updated Kor Ror 2 is what they normally want.
