BANGKOK, 12th December 2016 (NNT) – The chairperson of the Constitution Drafting Commission, Meechai Ruchuphan, has confirmed that the permanent charter protects citizens’ rights while at the same time keeping the three branches of the government in check. 

Meechai has called on all sectors of society to play by the rules and together restore peace, unity, and democracy in the nation. 

He said the essence of the permanent constitution is to protect people’s rights and to ensure that all three branches of government - administrative, legislative, and judicial - have mutual "checks and balances" enabling each to maintain the balance of power and not to exceed the constitutional limits. 

In addition, the charter provides a platform for everyone to be part of a peaceful society without any individuals holding power over the others. He said everybody has equal rights and responsibilities and is subject to the same laws and no one, however rich or powerful, is above the law. 

Lastly, he said the constitution is flexible and can be amended and updated, depending on the context and the nature of society and the world.

This constitution is to protect the elite' rights....and to keep the masses numb and quiet.

The constitution limits individual rights, making them absolutely subordinate to the arbitrary discretion of the courts. There are no checks on the senate or on the military junta. It enshrines the defacto superiority of some over others into law. It is not flexible and cannot be amended without near-total consent of the Prayuth-appointed senate.

 

Essentially the opposite of every claim made is the actual situation, but the truth must be told because it is the only weapon the decent and honest have left.

For the 80% or so of Thais who haven't read their soon-to-be-promulgated Constitution (http://englishnews.thaipbs.or.th/poll-says-majority-of-thais-didnt-read-draft-constitution/) the Rights and Liberties of the Thai People are defined in Section 25 Paragraph 1 thus:

 

Where provisions of the Constitution are specifically enacted to protect the rights and liberties of the Thai people and no act is prohibited or restricted by the Constitution or other laws, a person shall have right and liberty to commit such act and be protected under the Constitution in so far as the exercise of such right or liberty does not affect or harm to the security of the State, public order or good morals of people , and is not in violation of the rights and liberties of other persons.

 

So, the protection afforded by the Constitution (as alluded to by the CDC Chairman) may well be nullified by the prohibitions and restrictions in other laws.

 

Meanwhile, the shrivelled-up little weasel continues to talk at crossed purposes. Firstly, he says that the essence of the permanent constitution is to protect people’s rights, then he is telling us that "...the constitution is flexible and can be amended and updated, depending on the context and the nature of society and the world...".

 

Sheez, the "people's" Constitution hasn't even come into effect yet, and already Meechai is mooting "flexibility" in amending and updating it. The junta and its cronies really want to have their cake and eat it too !!!

I have mixed feelings should I laugh or cry. Keep the government in check yeah sure.

You are quite right of course, but folk did the best they could to warn others they would be shafted, but out they went and voted for it anyway. I really don't know how much sympathy I have at times...

Always thinking about the People's Rights. However, he didn't define "People" or "Citizens". "Amended and updated", depending on who is in power, or who wants to take over the government...and what their immediate needs are.

Translation :  We may interpret the law as we see fit based on how we feel at any given time.  Lawyers and debate are no longer deemed necessary.

I nearly choked on the opening statement. I will never understand how this community signed there human rights over to a undeveloped army. I bet they live to regret. Keep smashing the baht Prayut.
