An American guy already married to a Thai lady for 4 years, has got marriage visa, now wants to work/start a business. Already the 400K in the bank for the marriage visa so no problem but would be better if next time to get marriage visa on income from overseas and not the savings. Because that could be used to start a small business. We heard the procedure for Americans is a bit different to other nationals so.... can he start business without a thai business partner?

Where does he plan on applying for the visa. Most embassies and consulates do not require financial proof to a apply for a non-o visa based upon marriage to a Thai. There is no visa called a marriage visa.

If he gets a non-o visa he could then apply for an extension of stay based upon marriage at a immigration office. He would need 400k baht in a Thai bank in his own name for 2 months or proof of 40k baht income (there is no difference between nationalities to apply for the extension).

Under the amity treaty an American can own a business or company without needing a Thai partner.

Already has the visa for 3 years. He wants to work and has chance to either have business or be employed. But he wanted to know if his overseas income he brings in to Thailand can be used as 'proof of funds' instead of keeping the 400K in the bank. The 400K would or could be better used to set up in buisiness rahter than lying dormant in his Thai bank. I think we will go to a lawyer and see if there is info on the best way forward.

If an american can have a business that is good, to support thai wife and child with something that benefits everyone.

Check the requirements and types of business you are allowed to do under the treaty allowing a US citizen to own a business 100%

Might not be as easy as you've been told or think.

From what I read you will need at least 2 to 3 million baht as capitol .

Just google  amity treaty thailand america

If was easy every american married to a thai would be running a business.

If he has income from outside the country equal to or greater than 40k baht he can do a income affidavit at the  US embassy to prove his income to apply for an extension of stay (it is not a visa).

There would be no need or requirement to set up a company to claim the income.

Has anyone out there opened a small business using the amity treaty or does anyone know of someone who has, not friend of a friend etc.

I've been told about this option by many Americans who use it as a sort of ' I'm treated better than you' point but in 20+ years I've yet to meet someone who's actually done it.
