But some guarantees don't seem to be guaranteed... recalling Fox...

Fox involved a bank guarantee for revenues from another party which the bank reneged. Fox is suing the bank I believe for breach of guarantee.

The bus guarantee involves a public municipality/agency which should "under normal practices" provide a higher degree of assurance. But if the guarantee agreement is tied to specific performance conditions by the guarantee party such as bus equipment, guarantee's failure to perform would I believe simply void the guarantee - no contract breach necessary. But if BMTA outright rejects acceptance of the buses without regard to guarantee performance conditions, it too might be in breach of the guarantee agreement.

Again this is Thailand where legal rights can be unpredictable in their enforcement. And the courts seem no less reliant.

Guarantee payments such as the one paid to BMTA for the bus contract that have actually been made cannot be anything other than guaranteed.

The buses are sitting in the BMTA site on Rama 9

I think I saw one out on the road at Ngam Wong Wan last Saturday or Sunday, I think it was.  The number 522, Rangsit to Victory Monument.

As alluded to above, it might more interesting to know who actually owns Bestlin Group and why they thought they would be able to by pass those ASEAN requirements.

Certainly on their website they claim to buy Chinese buses and bring them into thai service which is what they did.

http://www.bestlingroup.com/en/service

They could also do with an English speaking person fixing up their website. Maybe one of the tourists who they state " prefer Sunlong bus (sic)".

So the Bestlin Group is distributor and sales for Sunlong Busses from China.
Correct?

Appears to be the case as per their website. They certainly dont hide that this is their core business.

Well, at least Sunlong Busses are not that bad.
While I was in China, I mostly saw Sunlong, King Long and BYD busses.
Btw, BYD had nice hybrid busses.
