New Constitution returned to the government from the palace

BANGKOK: -- The government has received the new constitution from His Majesty King Maha Vajiralongkorn last Friday for amendments within 30-day timeframe, Deputy Prime Minister Wisanu Krea-ngarm said on Monday.

 

He said he was not worried with the timeframe and the procedures to be undertaken the 30-day period which include examination of the amendments by the Council of State and traditional crafting of the charter in paper.

 

Constitution Drafting Committee chairman Meechai Ruchupan, meanwhile, assured that his committee would not take a long time to amend the constitution.

I'm lost here. So the constitution approved by the referendum is now amended after the referendum. Isn't there a time limit between the referendum and royal endorsement for the constitution to be valid?

I believe it's the NCPO  Interim Charter that has been amended. Until the King endorses the 2016 draft constitution passed by public referendum, the Interm (aka Provisional) Charter remains in effect. To that end Prayut is empowered as Chief of the NCPO to unilaterally amend the Interim Charter without public approval.

I think it's OK to say as it has been in the press...the King's personal private secretary asked the "government" to make some changes in the draft constitution - not the interim constitution - pursuant to the section which refers to the Monarchy, the details of which must remain private until the Constitution is gazetted. The "government" forwarded those proposed change to the NLA where they were approved quickly, incorporated and then sent back to the Palace for approval/review. {I think the interim constitution was previously modified, which allowed the draft constitution to be modified.) I doubt everyone wanted it to be this convoluted but apparently it was the only "legal" way to change the already-ratified draft charter?

 

Presumably all will be finalized, written up in the official format, then submitted for Royal approval and subsequent gazetting.
