Suspected predator stabs woman at bus stop, charged with 'indecency'

BANGKOK — A man was arrested on charges of assault, public indecency and carrying a weapon in public for allegedly attacking and attempting to rape a woman early Monday morning in northern Bangkok.

 

Capt. Chukiat Chatarupa of Don Mueang police arrested Suppakorn Kampol, 45, for assaulting a woman at a bus stop at 12:10 am on Phahon Yothin Road near Bhumibol Hospital.

The fact that he said he wanted to rape her, and he took several actions in order to rape her ..is not enough to charge him with attempted rape? 

 

It says it can only be prosecuted if there is evidence of "intended penetration of tongue or genitals."  What does that mean here?  With the lack of forethought displayed by the average person ...intent doesn't really exist, it is the same as NOW ..so IF it happened that is rape, if it didn't happen, that is not rape, so attempted rape, doesn't exist ..therefore we see how this crime was not attempted rape ..was it???

 

He dragged her off (kidnapped her), then beat her and stabbed her (attempted murder?), then he wasn't successful ONLY because other people came due to her screaming and stopped him!!

I would think he statement that he intended to rape her, along with having forcibly dragged her off,  would more than qualify as proof of "intended penetration of tongue or genitals."

 

Not sure that attempted rape carries a high penalty in Thailand though.

 

And indeed, having stabbed her could be grounds for a charge of attempted murder.

Well, the police shouldn't be the ones only responsible for determining what the charges will be.  I think they can't understand what "intent" means in regards to the law and I can see that in this culture, it means almost nothing.

 

If you are drunk ..it means you can't form intent ..they think.

 

If you want something, you should have it ...C'est tout!!

 

How many times do you hear ..after somebody delivers a fatal stabbing to the neck, shoots someone in the head, drives over them in a car, ..."well I didn't MEAN to kill them" yes well that is what happens, and that is the intention of your actions, legally!!

 

All of the actions of this man are clearly intent to rape, as well as his statement but w/o that, we don't need that.

Since the stabbibg aimed at her chest there seems to have been an intent to kill. A spur of the moment intent, out of fear her cries would summon help, but an intent nonetheless.

Yes, correct Sheryl ...it doesn't have to be proven to be premeditated ...only in the case if you are trying to prove 1st degree murder,
