Because it had not been tested before. Any number of things every President does could be deemed illegal once they get out of office. Had the Biden-Harris DOJ not circumvented the law by avoiding congressional approval of Jack Smith’s appointment, that case would still be going. Judges and congress have immunity for the same reasons the President does.
