  1. It's the Immigration desk official classed as competent that issues and collects the fines, in essence. They are also authorised to give receipts.
  2. As pointed out previously, this visa is aimed at different groups, not long stay retirees or married to a Thai on 1-year extensions of stay.
  3. Nor mine! For 9,500 baht over 5 years, I'm guaranteed to be able to stay for 365 days each and every one of those 5 years.
  4. I think you'll find all Immigration officials are authorised as 'representatives' of the Immigrations Divisional Commander to issue penalties.
  5. According to the Immigration Act, the penalty for non-compliance with section 37(5) is listed in section 76. Section 76 : Any alien, alien, who fails to comply with the provisions of Section 37(2),(3),(4)or(5) shall be punished with a fine not exceeding 5,000 Baht and with and additional fine not exceeding 200 Baht for each day which passes until the law is complied with.
  6. Multi entry Non Imm O visa, grants a stay of 90 days on entry. The permission of stay can be extended by 60 days to visit Thai spouse/family. Border hop after 150 days for a new 90-day entry.

  8. By the letter of law, he's entitled to one more VE entry by land, and unlimited entries by air. There is his problem. An Immigration official can deny entry if he feels you're spending too long in Thailand without the correct visa type. That is the best advice.
  9. Confused, did you attend in person or was it an agent. Once you file a TM30 registering your residential address, there shouldn't be a problem requesting a certificate of residence as proof of your address. I entered on a single entry Non O, filed a TM30 the following morning, then when they issued the receipt, I requested 3 certificates of residence, one to purchase a motorcycle, one to obtain a Thai driving licence and the third to open a bank account. Your Non Imm O ME may only permit stays of 90 days (same as a Non Imm O SE) but it's valid for 1 year. You have Non Immigrant status and not a Tourist. I'd be taking the issue up with the senior IO at Nonthaburi.
  10. Assuming he arrived by air for his first entry, and he's already done a border run for a second entry + 60 day extensions. He's allowed to do one more land border crossing this year as @Tod Daniels stated + 60 day extension. He can apply for the Non O at Immigration. 400K in a Thai bank account.   11. A visa exempt entry grants a stay of 30 days. A Tourist visa obtained from a Thai Embassy/Consulate grants a stay of 60 days. In either case, your Immigration status is Tourist. You cannot extend a visa, you can extend your period of stay for 30 days as a Tourist. To obtain a 1-year extension based on Thai child, you must have Non Immigrant status, so he needs to obtain a Non Imm O visa. Where/who have the children been staying with when he wasn't in Thailand? Was he married to the Mother of the children when they were born? Where is the Mother now? Are the children living with him now?
  12. For foreign documents to be accepted as 'genuine' in a foreign Country then they have to be authenticated, certified, translated and the translation authenticated and certified. The process is known as 'legalising' a foreign document for use in another Country. If you married in Canada, your wife's documents would have undergone a similar process in order to be accepted in Canada. Guessing an affidavit, certification, translation etc, to present to the registry office in Canada. Your Canadian marriage certificate is in English and will be accepted by the Thai Embassy in Canada. At Thai Immigration many do not read and poorly speak English, they require a document in Thai from a local Amphoe as evidence you're legally married. You cannot obtain that document from the Amphoe unless your foreign marriage is registered in Thailand. To register your Canadian marriage, you have to go through the steps of 'legalising' your Canadian marriage certificate for it to be accepted as genuine, certified and translated to Thai.
  13. There have been varying reports with no consistency in the actual requirements. It appears to be at the discretion of the clerk at the desk.
  14. Try doing an entry on it. A valid visa permits at least one entry. You had a visa for about 10 seconds until they stamped 'USED' across it, at which point you're left with Non Immigrant status, but not a valid visa.
  15. I'm not the one twisting, and I don't mean that to be condescending. I originally stated 'IMO', which you appear to have taken exception to. Far from being a 'hi so' as you put it, I'm just an average expat. The question "Now Savannahket require 400K for the Non Imm O ME visa and I don't have 400K" is the million-dollar question, with no definitive solution or alternative to stay long term without financial implications. If/when the VE entry offers 60 days entries, then I'd suggest a border hop for 60 days + 30 day extension + 60 day extension + 90 day Non O. That would be cheaper than applying for a Non O at Savannahket and allow a stay of almost 8 months. However, and again just my opinion, you'd probably get away with it once, but as @Rob Browder stated, once Immigration cottoned on, they'd probably refuse further Non O applications and tell you to get the correct visa to stay long term, by which they mean obtain the Non Imm O ME, or a 1-year extension of stay. I know one expat who has managed to borrow 400K funds for 3 months to obtain the 1-year extension, from family, which he then returns with 10K interest. Don't know if that's a feasible option for you, but far cheaper than an agent.

  17. You directly asked me a question, I answered it. The fact it wasn't the answer you wanted to hear is your problem. You want to hear you can get multiple 90 day Non Imm O visas and 60 day extensions to continually stay in Thailand ................. nobody can guarantee that, and it's highly unlikely. Try it and let us know how you get on, old chap!

  19. If you enter VE or TV, then your Immigration status is as a Tourist. You cannot apply for a 1-year extension unless you have Non Immigrant status. For those intending to stay long term, but entered as a Tourist, Immigration offer an internal service to change your Immigration status from Tourist to Non Immigrant. (Non O) It's a service with the expectation, after obtaining the Non O, you would then apply for a 1-year extension of stay. Your agenda, from your previous posts and now the Non Imm O ME from Savannahket requires 400K in a Thai bank for 2 months, the same requirements as for a 1 year extension of stay based on marriage, you're exploring options to circumvent financial requirements. You've mentioned obtaining the SE Non 0 from Savannahket (no financials) + 60 day extensions as an alternative. Now, you're exploring the option to apply for the Non O through Immigration and save travel and visa costs to Savannahket. You've stayed here long enough to know the financial requirements, 400K for 2 months, or monthly overseas transfers of 40K per month, and you know changes can happen. IMO the writing has been on the wall for some time in regard to the Non Imm O ME being available without financials. As @DrJack54 experience, and nothing new, applying for back to back visas at Immigration or Thai Embassies will be met with eventual refusals. There is a legitimate pathway to staying permanently with your Thai spouse in Thailand, and that's nothing new.
  20. The Non O can be applied for at Thai Embassies/Consulates to enter Thailand for a number of reasons. The 'O' stands for 'Other', meaning it's issued under item 15 of section 34 of the Immigration Act as one of the many reasons for entering Thailand. Section 34 : aliens entering into the kingdom for a temporary stay may enter for the below listed activities 1. Diplomatic or Consular Missions. 2. Performance of official duties. 3. Touring 4. Sporting 5. Business 6. Investing under the concurrence of the Ministries and Departments concerned. 7. Investing or other activities relating to investing subject to the provisions of the law on investment promotion. 8. Transit journey. 9. Being the person in charge of the crew of a conveyance coming to port, station , or area in the Kingdom. 10. Study or observation. 11. Mass media. 12. Missionary work under the concurrence of the Ministries and departments concerned. 13. Scientific research or training or teach in a Research Institute in the Kingdom. 14. The practice of skilled handicraft or as a specialist 15. Other activities as prescribed in the Ministerial Regulations.   21. Wont work, at least not at my IO. The idea of obtaining the Non O is a prelude to then applying for the 1 year extension. You may get away with it once, then Immigration will view it as trying to circumvent the system, in effect, to obtain 90 extensions If you can put 400K in once for the Non O, why not another 2 months and obtain the 1-year extension. You can then withdraw the 400K as soon as the extension is granted.

  24. The Thai Embassy in Canada will accept your Canadian marriage certificate for the Non Imm O e-visa application, because they can check the Canadian marriage database to authenticate it. Thai Immigration cannot check foreign databases, which is why a foreign marriage has to be registered in Thailand, providing a local database that the Amphoe can check to issue the necessary document for Immigration, that according to local records you are still legally married.   25. If using the funds in the bank method, then you may be required to show the funds came from overseas only in your first encounter with Immigration. I entered on a Non Imm O, but required to provide proof the funds came from overseas for my first extension application. II - Yes. I have a fixed term deposit account with funds deposited solely for the purpose of Immigration. The only activity in that account is interest paid and tax deducted. I then have a Savings account for daily living expenses. At extension renewal time, I update both passbooks and request the bank to list both accounts on the standard letter. Not that Immigration has ever questioned my stationary FTD account, I just provide evidence of an additional account used for expenses. III - For Non O the funds are only required in the bank on the day of application (Jomtien exempt). Funds required in the bank for 2 months prior to submitting a 1-year extension application.
