We don’t know the condo rules, they are lodged at the land office and cannot be changed without an EGM or AGM and resolution passed. I have never heard of condo rules that say an owner has to provide details of his tenant, normally it’s about pets, rubbish, swimming pool etc. The laws around condo’s are enshrined in the condominium act, AirBnB wasn’t around when it was redrafted 20 odd years ago and there is currently no legal requirement for an owner to provide details of their tenants. If the JPM excludes the owner and tenant by changing the code, she is on shaky ground. She may see she is doing it because she believes the tenant holds less than a one month lease, if she is wrong she is on the hook for any damages owner/tenant incurs. Owner is a co-owner, if she acts unlawfully by excluding a co-owner I would either call the police or break the lock. Her only redress would be via the court and she would lose, probably lose her job too. -

If you have managed a condo building for 11 years then you MUST know your buildings rules and the condominium act. I don’t know your buildings rules but I do know the condominium act. I know the rules in the condominium building I have managed continuously since 2008 when I owned 40% of the building. Even though I haven’t lived there for 12 years I am still JPM. Our rules say nothing about owners must notify me of tenants names etc. The condominium act says nothing about owners must notify me of tenants. Owners are responsible for their tenants just like adults are responsible for their children. As JPM I am acutely aware the position is mostly toothless, there is some redress at the land office but mostly a dispute can only be resolved in the courts, it’s totally impractical and resolution comes down to social skills. The first question a court would ask me if I pursued an owner for not disclosing the name of his tenant would be under what law is he required to do that? And the answer to that question is there is no such law. I would be laughed out of court. I expect you don’t believe me, if you PM me, I will tell you the name of the condo building and you can check it out yourself. We also hold a dispensation that a foreigner can undertake this role. -

Please provide the clause in the condominium act or other legal clause that says, and I quote you, “that requires something to be provided by the condo owner” we are taking about providing tenants details in case you forgot. -
Let’s take some of your points… pouring Billions into solving the Hydrogen engineering ,production and storage issue in conjuntion with the vehicle manufactures and designers Yes, they are, but and it’s a big BUT, green hydrogen is considered the future https://www.mckinsey.com/industries/oil-and-gas/our-insights/global-energy-perspective-2023-hydrogen-outlook and for long distance haulage and public service type infrastructure only. To make green hydrogen you start with green electricity, a third of it is wasted producing oxygen and there are more losses involved and ultimately to end up with electricity again forom you fuel cell or you run a H2 ICE which we have already engineered over the last 120 years to its wonderful 25% efficiency. No number of billions invested is ever going to change that. So, yes you are going to see H2 vehicles mostly in the sectors I have described but also perhaps in countries with little electricity infrastructure (quite how they will develop a H2 infrastructure is beyond me). But the end of EV’s is not coming, we at the dawn of EV adoption and it’s only going to accelerate. We will have some H2 alongside EV’s but market dynamics regarding cost and availability will take care of the rest. When I am faced with a H2 car that costs 5 times more per km and is likely slower than a similar EV, my choice as a consumer will be self evident. But please feel welcome to buy your H2 car, ha ha as you said.

Actually, I hadn’t considered a declining overall market, I should’ve qualified that quote for this kind of situation too. However, I am convinced EV‘s are here to stay and then market share will only just creep up continuously. You mean like lipstick on a pig, for example? -

You’re going round in circles. The law has to be specific on what it requires and from who. It has to specify what an owner must do or there is no requirement on the owner simply because there is a requirement on the JP or JPM. Where there is a requirement, there is also a liability (fine or imprisonment) for failure to do so. I suspect there is a fine if the JP does not provide the details, but there is no such fine on the owner. Think it through, you’re not making sense. . -

I stand by what I said. Just because the law may require Person A to do something, it does not roll downhill to Person B to assist them unless specifically documented. There is probably a proscribed penalty on the juristic manager if they don’t keep the required documentation, what is the penalty on the owner/tenant if they don’t provide the documentation, the first thing is they have to be required to supply it (there has to be a law) and the second part is there will be a penalty if they fail to supply it, nobody is saying, either of those exists. Explain how and where I contradict myself please? For your convenience I repeat my post below… The law may say they need to keep such information, but it has to say that the owner or tenant has to give it for there to be any requirement on them to do so. -
Let me explain what I will do regarding tax free gifts. I am single, but have 2 adopted daughters. I have a moral obligation to look after them. Instead of giving them a monthly allowance, paying their university degrees, buying houses for them and buying them their cars. I will gift them once a year transferring from the uk to their Thai banks. They can pay all those expenses themselves, the cars they have which are registered in my name, they can buy off me, and I will transfer them into their names, they can pay their own university fees, and their own living expenses at university. There is also a house I bought for them at university, I will take advice on the money being a loan for them to repay.

if you sent the money from your home country to her bank and she bought a house and car, that is fine. But she cannot give you any of the money and you have to pay your own way not have her pay for everything. In any event, you both have to sign at the Land office to say it’s her money and therefore her house and that you have no interest in it, this is normal anyway I believe.

if it’s a gift 10 million baht, double that if you are husband and wife or parent and child. However, for no tax to be due, it is important that you never benefit from the gift, which means if you are closely related, then the recipient needs to be able to prove where the money was spent, and none of it went back to the giver.

Juristic manager may have a right, but she is toothless. I don’t think there are any clauses in the condominium act or otherwise that say you must comply, she can request, and it may be reasonable, and my approach would be if the request was reasonable, and politely asked, I would comply, but if she was bombastic and officious, I would tell her to go jump herself -

Tell her privacy laws mean you can’t comply and unless there is a legal requirement, you would be breaking the law disclosing such information. Tell her you would love to comply so please disclose which part of the condo act or other law says you have to comply. She may be checking to ensure your lease is at least one month required by law. If it isn’t, don’t disclose it. if she insists and lease is at least one month and you’re agreeable, give her copies with names, addresses, passport, numbers, and phone numbers redacted. -

There are 2 sides to every story. I am a landlord too, but I always return deposits even when I shouldn’t (cat damage). I am not saying I would do this but perhaps not pay the last 2 months and don’t be revealing that fact until as close to the end of the lease as you can talk your way to. -

Last night one of my tenants asked me if his house had enough power as he was thinking of buying a BYD Seal Premium. This morning I got a message from Rêver saying if I introduced someone then I would get 30,000 baht credit on the Sharge app. He hasn’t gone to the dealer yet and so I introduced him. They confirmed he was not already known to them. I was thinking, I may offer him my Seal Performance, I got a message on Monday from MG that they will be calling me soon for the colour combination on my Cyberster. They haven’t yet said whether they will give me price protection, I suspect they might but will ask me to sign an NDA. The longer they delay, the more I think they might.

The only reliable figure we can work with is registrations. Sales is whatever the dealer or manufacturer says they are and completely untrustworthy. It's interesting to compare bookings at motor shows, but it's completely unreliable and open to overstatement. -

I disagree. A car bought in early February could well appear in February registrations. Chiang Rai runs 2-3 weeks lead time in issuing Tabien Rot. I do agree that a months registrations are mostly the previous month's sales.
