One question concerning a Last Will and Testament
scorecard replied to Keith5588's topic in General Topics
Just remembered more detail. The case was a very senior ruthless army general who had a wife and children and several minor wives and had lived publicly full time with the final minor wife for 2 decades or more. The children (adults at the time of the generals death) barely knew their birth mother and saw her as an an unpleasant woman. They had grown to be very attached to the minor wife. Upon his death a will was found which had been written several decades earlier before any children were born and the will bequeathed everything to the original wife who hadn't had any contact whatever with the general or the children for decades, including no contct with the children from when they were toddlers. The children together with the minor wife approached the court asking to be recognized as recipients of the generals rather large amount of land and buildings and cash. They won. -

One question concerning a Last Will and Testament

The cases which, over the years appeared in the Thai medi (in full details) were very extreme cases. I agree the wishes of the deceased should be respected. What's also possible is for the siblings who did inherit and also thought ignoring one specific sibling was unfair, could all contribute to a fund (after the intial distribution of the assets) for the 'ignored' child. -

The quote you mention is outrageously expensive for a basic will, perhaps that fee includes: - preparing, signatures and registration of a power of attorney and - also maybe includes a living will? -

From above: " For assets in Thailand for a probate with a Thai court, the will must be in Thai language - this is at least what I can say that because of statements from a very experienced lawyer on the subject. " I'm surprised that people don't realize/support that the will should be in the native language of the country (with translations as needed). -

Yes it has happened in Thaiand and become public. In the couple of cases I recall there were very extreme circumstances which pushed the judge to amend the will. And in at least one of the cases all of the family members strongly backed that there was no valid reason why the sibling who was ignored by the mother should not receive the same benefit as all the other 3 or 4 siblings. -
Who has retired to other Asian countries?

My many work experiences in Phils., put me off. By company policy mostly stayed in contracted '5' star hotel in Makati, overall very poor service, tips expected for saying 'hello', always seemed to be laundry problems, food in the hotel poor quality and seemed to be problematic. Wait forever at lobby counter to check-in and more. Mistakes with cars ordered through the concierge. My own office in Manila poorly run, female manager less than pleasant and abusive to staff and in one incident she abused several Snr. Japanese directors of the company (all spoke good English). She was asked to organize a big van to take me and the Japanese directors and 4 Japanese snr petroleum process engineers to a processing site 1.5 hrs from Manila. She ordered a van way too small then pushed for the Japanese enginers to sit on the floor. I pulled her aside and told her shut up and listen and reorganize the whole plan and be ready to depart in 2 hrs. She claimed it was not possible. I called the GM of the hotel and asked could he organize a bigger van within 2 hrs and with a quality careful driver. He confirmed. The van came to the company office 1.5 hrs laterwith a man from the hotel lobby to travel with us at no extra charge to ensure we were happy. Good trip, careful driver. I charged the hotel bill to the travel costs of the Phils. office much to madams annoyance. Within next 6 mnths she was sacked, mostly for her abuse of company staff and customers. -

"Bali too far": Flight time Sydney to Bali (Denpasar) 6 hr 20 min. Flight time Sydney to Bangkok 9 hr 15 min. Plenty of quiet beautiful locations in Bali away from the tourist areas low cost of living, and more English spoken than in Thailand. Yes, a lot of crime in Phils, and many folks walking around with legal handguns. -

No he's not. When he was PM he was impressive, good policies, transparent, fighting off cronyism, but very very slow at everything which was his downfall (in my opinion). -

Good point, possibly several or more country leaders who have concerns that: Sitting with him / being at the same meeting is sanctioning his actions. Sitting with him / being at the same meeeting will damage their own reputation / damage their own standing and credibility. Sitting with him / being at the same meeeting will produce misunderstanding who they support in the war. -

Also beware of amphur staff getting involved / too involved in writing the will. Some amphurs have staff who are tasked to help write wills but this can become a 'ptoblem': - Amphur staff insisring on certain clauses. Example: my Thai nephew got married and a bit later went with his Thai wife to the Amphur to write his will (This had been suggested by older siblings of his Thai wife). - Amphur 'officer' inisted that by Thai law nephew's will must state that nephews' mother in law receive 100,000Baht upon his death. Nephew queried this and was instantly confronted with comments about disrespect for his MIL. Nephew made excuse to leave and come back later. Nephew contacted old school friend now a practicing Thai lawyer and asked if there was any such law re money for MIL? Answer NO, no such law, nothing like it at all. Nephew went back to amphur office with wife and lawyer. Lawyer asked same amhur 'officer': - To show him a document/any documen/a Thai act which states 'must leave monty to MIL'. Amphur lady couldn't produce any such document. - Lawyer asked her 'have you actually seen this in writing in an official document, or is there any such document in this office?' Answer NO. - Do you have a law degree and do you have any raining about writing wills? Answer NO and NO. Lawyer then asked her why she had insisted that there must, by Thai law, be a clause in hephew's will bequeathing 100,000Baht to nephew's MIL. Her response: 'But I think it's a good idea'. Then amphur officer fled and wouldn't come back to the 'meeting'. Her supervisor came and got very angry with my nephew and his wife and the lawyer , saying, 'why do you ask questions and why do you come here making trouble?' Nephew's wife then politely asked the lawyer 'Can you please write my husbands will and a will for me too please? Lawyers replied 'YES'. No further discussion with Amphur staff, nephew, wife, lawyer stood up and walked out. -
Do you take Magnesium or similar based medications for muscle spasms? I often get back, leg, foot muscle lock, which is of course very painful. I discovered years ago that Magnesium, Bio-magnesium or similar tabs give quick full relief.

"This topic comes up here periodically and the general consensus is the Thai laws do not help the foreign parent much...." I'm not sure that's true. Seek some proper legal advice from a respected lawyer.

Stop getting armchair comments, seek out and discuss with a well respected lawyer.

You can request such services after the initial booking but (as already mentioned) best at least 3 days ahead to ensure there's enough time for TG to get it organized.

One question concerning a Last Will and Testament

Nice points. My comment was just a suggestion to see if the two versions differ significantly. I concur that both versions must totally agree. I also comment, people can write their own will, but need to be quite careful that: - It's not possible there could be 2 or more interpretations of the words / meaning of the words. - What's written in one part of the will doesn't clash in any way with what's written in another part of the will. - What's written in the will is not actually illegal. -

It's not surprising that there must be a copy in local language. To test what's in the written in the Thai version, find someone who reads/speaks both languages well. In private, show them the Thai version (Thai version only) and ask them to translate it to spoken English for you. What they say in English will quickly tell you whether it's what you intended or not. -
Police teaching children how to "Run-Hide-Fight" in wake of massacre

Creating a strong society where there's good/equal opportunites for education and work would also help to minimize the numbers of people who feel isolated and helpless. Much more sophisticated recruitment processes for the RTP would also help so that folks who are likely to have mental issues are not recruited. And that should include higher levels of education are required to be admitted. Serious change in education methodology would help so that kids are encouraged to ask questions to more deeply understand their lessons, and therefore better equipped to quickly create a response to anything in life. Much more effective methods to reduce the abundance and easy cheap access to drugs in society would also help.
