We brought a new car in November of 2012 and got the 100,000 baht tax rebate, as I understand it your not allowed to sell the car within 5 years of buying it???? well we would like to sell the car sometime towards the end of next year which will only have been 3 years, does anyone know what happens, do we have to pay the rebate back to be able to sell it, are we able to sell it at all?

  2. Under the new rules, effective for all settlement applications made on or after 9/7/12, the initial visa is valid for 33 months and the holder can apply for FLR after living in the UK for 30 months.

    This FLR is valid for 30 months and the holder can apply for ILR when it expires (actually 28 days before that date).

    Making a total residential requirement for ILR of 5 years.

    As before, there is no fixed limit on time allowed outside the UK during this 5 year period.

    I get it all up until your last point 7by7. In order to qualify for FLR, the visa holder needs 30 months of time spent in the UK. If the initial visa is valid for 33 months, then that implies to me that the applicant has effectively 3 months of that visa to work with, for either getting their affairs in order before leaving Thailand and/or for trips back to Thailand, in order to make the 30 months for FLR.

    Assuming said person makes use of these 3 months (outside of the UK) and applies successfully for FLR based on their 30 months in the UK, then in order to make the 5 years/60 months requirement for ILR, then wouldn't they have to stay in the UK for the full 30 months of FLR?

    Put simply, the initial visa and FLR visa extension combined, run to a maximum of 63 months, so to qualify for ILR with 5 years/60 months in the UK, means 3 months maximum to play with?

    What am I missing?

    I think it's time based in the UK, not actually physically spent in the UK, the time spent in the UK applies for the last 3 years of the 5 year path if your going for naturalisation.

  4. Hi all, we shall be applying for a UK settlement visa next year, just getting my ducks in a row at the moment. We would like to travel at the same time as the visa starts but would like to post date the start of the visa, I understand you can do this by 3 months but looking on here it seems that settlement visas can take up to 3 months to be processed anyway, so could we in effect submit the application with a start date of 4/5/6 months later as it will take a few months to get an answer??

    I'm officially an expat and haven't been on the electoral role for years, I will be registering when we get back but will this make a difference to our application?

  5. both those 7by7, basically last time in the UK she overstayed and they recently applied for a 6 month and got refused, I hadn't seen the letter when I posted the question but I have now and it's clear that the overstay was the main reason, it wasn't addressed in the application and there were also a couple of other issues which caused a problem, so he's okay now with what he has to do and thank you Thaivisaexpress for answering the question of - can they apply straight away again etc, they will do but of course will address all of the issues raised in the refusal letter.

  6. Thanks for the replies folks, I've since seen the refusal letter (I hadn't when I posted this) and it's pretty clear that it's lack of information on several counts, the overstay and reason for - being the main one, but it turns out there were a few other little issues.

    We still have the question of - can you apply again straight away or do you have to wait some time i.e a month etc??

  7. A friend of mine recently was refused a 6 month UK Visit Visa as the last time his Mrs was in the UK she overstayed by 5 days, I don't think they addressed that in the new application as I believe there was some confusion about the dates, anyway they got refused because of the overstay.

    They are married and this will be her 3rd trip to the UK, whats the deal now about reapplying, is there a time restriction or can they apply straight away, within the new application they will explain the situation and address the overstay, will this be enough?

    What more can they do?

  8. I've been having my ears vacuumed out on a yearly basis at Memorial Hospital for about 8 years, I actually had it done about a month ago, the price is now around 1,600 baht, you have to go after 1pm as thats when the ear doctor is there.

    There is an ear clinic on Pattaya Klang just before 3rd road on the left but it's opn 6-8pm Wednesday, Fridays and Saturdays, you can get it done there for about 400 baht, I would have had that the other week but I was in pain and decided just to bite the bullet and get it done that day.

I will try again to get a Non 'O' from Hull when i'm back in the UK soon, I tried last year but was unaware the goal posts had moved again and a simple wedding certificate wasn't enough any more, anyway I see that you can get the visa if your visiting your child, I live in Thailand, married and we have a little boy, the requirements are:

    1. 2) Visiting Thai child living in Thailand.

      Evidence required

      a) Birth Certificate of child showing relationship.

      B) Proof of having Legal Custody of the child.

      Please note that a child is regarded as an adult when attaining 20 years of age.

    I have mailed the consulate in Hull about B) proof of having custody and the last said it's a Thai legal document that I have to get from a Thai lawyer here, does anyone know the name of this, have you done it etc?????
