  1. * § 17–152. Conspiracy to promote or prevent election Any two or more persons who conspire to promote or prevent the election of any person to a public office by unlaw- ful means and which conspiracy is acted upon by one or more of the parties thereto, shall be guilty of a misdemeanor. (L.1976, c. 233 , § 1.) * As posted above the statute refers to "unlawful means" but it does not say what constitutes 'unlawful means'. I decided to try to find out in all the other previous prosecutions of the statute, since that statute dates from 1976, what constituted "unlawful" means. But I could not. As best as can be determined even by lawyers with years' experience prosecuting election violations in NY State, that statute has NEVER been prosecuted so there is no trail of what constitutes "unlawful means". So even though Judge Merchan in a ruling has said that the statute is applicable as a possible (an)other crime, they first have to justify without precedent what constitutes "unlawful means". In other words they would be using a 2 part if-then statute to justify a two part if-then statute. Or as one NY State election lawyer put it: Crimes, within crimes, within crimes. * https://elections.ny.gov/system/files/documents/2024/04/508_ny-election-law-2024-edition_0.pdf STATE OF NEW YORK 2024 ELECTION LAW
  2. My experience flying from USA with many airlines is that they will hold (in this case) the Taipei to Bangkok flight if they know there are connecting passengers as long as the hold is minimal.
  3. This is from the indictment and repeated for each of the 34 charges: The defendant, in the County of New York and elsewhere, on or about February 14, 2017, with intent to defraud and intent to commit another crime and aid and conceal the commission thereof, There is no mention or charge of election interference in the indictment, only "another crime". https://manhattanda.org/wp-content/uploads/2023/04/Donald-J.-Trump-Indictment.pdf
  4. I think you are maybe confounding the Indictment with the "statement of facts". Read the full Trump indictment and statement of facts https://www.politico.com/news/2023/04/04/read-the-trump-indictment-document-00087925
  5. There are plenty enough on here who support the Prosecution. There are also plenty enough left-leaning legal scholars and former Prosecutors who are not happy with the mechanics of the Bragg case.
  6. Hicks helps Trump’s ‘Melania’ defense Hicks handed a gift to Trump when she testified on direct examination that the reaction of his wife Melania was his biggest concern on the morning that the Wall Street Journal article detailing the hush-money payments came out three days before the 2016 election. “He was concerned about how it would be viewed by his wife,” Hicks said. The Trump team suggested in opening statements that the main reason why the catch-and-kill scheme to buy Daniels’s story happened was because Trump found it embarrassing for him and for Melania – an alternative explanation to prosecutors’ case that it was to influence the election. Prosecutors subsequently tried to have Hicks add that Trump was also concerned about those stories derailing his 2016 campaign, but Hicks only offered that Trump was always asking how certain news would “play” with voters. https://www.theguardian.com/us-news/article/2024/may/03/trump-trial-hope-hicks-testimony-key-takeaways
  7. DEFAMATION LAWSUIT Daniels filed a 2018 defamation lawsuit against Trump in federal court over a Twitter post in which he accused her of a "con job" after she described being threatened over publicizing her account of the alleged sexual encounter. A Los Angeles-based federal judge decided in 2018 that Trump's remarks were not defamatory and were protected by the U.S. Constitution's First Amendment's guarantee of free speech. The judge's decision was upheld on appeal. The U.S. Supreme Court in 2021 declined to review the matter. Daniels has said an unknown man approached her and her infant daughter in 2011 in a Las Vegas parking lot and made threats after she agreed to talk in a media interview about her relationship with Trump. In 2018, Daniels released a sketch of the man. Trump responded on Twitter to the release of the sketch, writing: "A sketch years later about a nonexistent man. A total con job, playing the Fake News Media for Fools (but they know it)!" https://www.reuters.com/world/us/who-is-stormy-daniels-what-did-she-say-happened-with-trump-2024-02-15/
  8. Hearsay. Someone else told her. Trump divorced Marla Maples June 8, 1999 Melania and Donald Trump married in January 22, 2005 6 years to have non-adulterous sex.
  9. From APRIL 11, 2024 Then there’s another, less explored route that Trump’s team could try: asking the judge to give the jury the option of convicting him on lesser, misdemeanor offenses instead of the felony counts that have actually been brought by Manhattan District Attorney Alvin Bragg and his team of prosecutors. A person familiar with Trump’s legal strategy told me that some of Trump’s lawyers have quietly — albeit tentatively — considered that option in the run-up to the trial, which has not been previously reported. Trump’s attorneys did not respond to a request for comment. “Now, obviously he doesn’t want” to be convicted at all, the person familiar with Trump’s legal strategy said, “but a misdemeanor conviction in state court in Manhattan is going to have absolutely no effect on this guy’s ability to run for office or on his liberty.” https://www.politico.com/news/magazine/2024/04/11/trump-alvin-bragg-trial-win-00151558
  10. Shake-down allegations and another contempt hearing highlight 10th day of Trump’s trial Prosecutors said Trump was creating an “air of menace.” Trump’s defense team suggested a key witness was an extortionist. 05/02/2024 08:55 PM EDT On the Hogan sex tape, Bove asked Davidson if he had been investigated for extortion by federal and state authorities. “That’s true,” he responded. The Trump attorney then pressed Davidson on whether he had familiarized himself with extortion law so that he wouldn’t break the law as he navigated the Daniels deal in 2016. “I had familiarized myself with the law. I’m a lawyer,” Davidson said. https://www.politico.com/news/2024/05/02/trump-hush-money-trial-day-10-00155912
  11. Eric Trump maybe got approval from the Judge. * Trump is not on trial for extortion. But other than bookkeeping, the Prosecution still hasn't said what was the (an)other crime. * 6.03. Exclusion of Witnesses (1) Subject to subdivision two, a court may exclude a witness from a courtroom prior to the time the witness is anticipated to testify in that proceeding. https://nycourts.gov/JUDGES/evidence/6-WITNESSES/6.03_EXCLUSION OF WITNESSES.pdf
  12. May 2, 2024 During the cross-examination, the defense lawyer Emil Bove quickly sought to discredit Mr. Davidson. He accused him of toeing the line between seeking monetary settlements for his clients and extortion. And he warned Mr. Davidson that he was “not here to play lawyer games,” adding that he was seeking truthful answers. https://www.nytimes.com/2024/05/02/nyregion/trump-trial-keith-davidson-stormy-daniels-hush-money.html **************************** Updated 2:12 AM GMT+7, May 3, 2024 (Emil) Bove also noted that Davidson had been involved in similar hush money payments for clients that had nothing to do with presidential politics, grilling him about previous instances in which he solicited money to suppress embarrassing stories, including one involving wrestler Hulk Hogan. By the time Davidson negotiated hush money payments for McDougal and Daniels, Bove asked Davidson whether he was “pretty well versed in coming right up to the line without committing extortion, right?” “I had familiarized myself with the law,” Davidson replied. https://apnews.com/article/hush-money-trial-new-fines-testimony-trump-fe6995afbc96650b67f46d813ab05f06 Quote

  14. Already is. That's who picks the crops. But as I said I would like to see Biden win, it is far from a sure thing.
  15. As someone who has a long-term family in Florida and myself for 20 years before moving to Thailand I would sure like to see Biden take Florida. But the nature of the elderly retired population in Florida is that their kids and grand kids often or mostly do not live in Florida.
  16. Published Apr 29, 2024 at 11:37 AM EDT Biden faces concerns among young voters, a crucial voting bloc for Democrats, ahead of the presidential election, according to a March poll that found former President Donald Trump winning voters younger than 30 years old. Political strategist James Carville has gone viral on social media after cursing young voters over their perceived lack of enthusiasm for incumbent President Joe Biden. "There will be no government left, there will be no rights left, you will live under theocracy, you'll end up with Christian Nationalism [if Donald Trump wins]," Carville said during a 12-minute video posted to the Politicon YouTube channel. "But that's all right you little [expletive] 26-year-old, you don't feel like the election is important." https://www.newsweek.com/james-carville-curses-young-democratic-voters-viral-video-1895185
  17. A post-verdict appeal can also be based upon some of Judge Merchan's pre-trial rulings.
  18. That it turns out it is standard NY State criminal procedure as an 'expert' who is not familiar in detail with the facts of the case cannot offer any opinion on whether a crime has been committed.
