Here is another interpretation from another news article: Thailand Revenue Department’s Latest Order Expanding the Tax Assessment of Individuals’ Foreign Source Income On 15 September 2023, the Thai Revenue Department (RD) issued RD order no. Por. 161/2566 (the “New Order”) providing new guidelines for income tax assessment per Section 41 of the Revenue Code. The notable change is that, going forward, a resident of Thailand would have the obligation to assess income from foreign sources as a part of assessable income of the tax year (i.e., calendar year starting from 1 January to 31 December of such year) which it is brought into Thailand. This New Order will be effective on 1 January 2024. So the new guidelines are that RD issued POR. 161/2566?

  6. Thailand does not tax wealth. It is income tax. How do they find it and possibly tax it, like everywhere else, one has to declare it and submit a tax return with backup. How do they control it, long stay residents present a tax residence certificate at departure. The rest is just speculating.
  7. Exactly, nothing is finalised. Of course the transfers may be considered as income but it is only a transfer and deposit to the bank account, the bank and the tax people at this stage know nothing about the history of that money and there is no law or reason to tax it at transfer and deposit stage. A tax, if any, will only depend on an interaction between the resident account holder and RD.
  8. Yes because those streams of income (Thai based dividends and Interest) are accrued in Thailand and they are known how to be treated according to the law.
  9. Theoretically if hes working in Taiwan he should be paying tax there so the money he is remitting to Thailand is savings and would not be subject to reporting and tax.
  10. For CRS there is nothing to do. Pension. Is this a govt or private pension? because there is an article in the DTA between Korea and Thailand covering pensions. Is Korea deducting tax off the pension?
  11. The banks are not going to tax your transfer or deposits. Even now RD have to go through a procedure to get info about bank accounts from a bank about a delinquint tax payer. Tax is handled by the RD at the end of a tax year following the law and the tax code.
  12. I don't think that is the case. Thailand is taxing only income remitted into the country, like many countries do.
  13. Perhaps this is the case. I would think Thailand just considers most foreigners to still be tax residents of their home countries. They will report the bank account income and balance in bank accounts info to RD, RD fill in the CRS form every year and then its up to the home country to sort out.

Tax returns All persons earning income are required to file a tax return no later than 31 March of the following year for hardcopy filing and 8 April for online filing, except for individuals whose income from employment is THB 120,000 or less (for single persons) or THB 220,000 or less (for married persons) and in the case of having income from other sources (with or without employment income) of THB 60,000 or less (for single persons) or THB 120,000 or less (for married persons). Individuals engaged in most forms of business are also required to file a return of their income for the first six months of the year by 30 September and pay the tax due. Each husband or wife earning income can choose to file their income tax return either separately or jointly with their spouse, whichever they prefer.
  15. Read the tax code section 41, one is tax resident if one is 180 days (aggregated) or more living in Thailand. I did not make that up. Now there may have been specific article excluding the income when remitted but you are still tax resident.

We are specifically referring to income received from renting out a property in a foreign country as stated in the OP article. If that income is not brought into Thailand then it is not reportable income. If the income is brought into Thailand it must be reported.

I don't know, but I would think not unless there was a specific decree or revenue department order But this below is from the Thai Elite Visa website which is in line with the RD tax code If you stay in Thailand for 180 days or more in a tax year, any foreign income you bring into the country will be taxable. This includes money from jobs, businesses, or properties abroad. Starting January 1, 2024, any foreign income you bring to Thailand will be subject to tax. If you’ve already paid tax on this income in the country where you earned it, Thailand might offer some tax relief. Thailand has agreements with some countries that might allow you to reduce your tax based on the tax you already paid elsewhere. It’s advisable to contact us for detailed guidance.
  18. Please now that is making stuff up. IF it is remitted (ie brought into Thailand). If it is not remitted it does not have to be reported.

  20. Oh my goodness, how did racial discrimination enter the conversation. Many Thais do not submit tax returns because many are exempted by their tax threshold.
  21. Some are even speculating all foreign bank transfer remittances are going to be taxed by the banks, haha.
