Pattaya firms raided in foreign nominee probe

Thai authorities have searched three locations in Pattaya and Bang Lamung as part of an investigation into suspected Thai nominee arrangements used to hold land and run businesses for foreigners.

The operation on 21 August was led by Deputy Interior Minister Waris Leangprasert and Justice Minister Police Lieutenant General Rutthaphon Naowarat. It involved the Department of Provincial Administration's (DÒPA) special operations unit, the Department of Special Investigation (DSI) and police.

Search warrants were issued by the Criminal Court under the Foreign Business Act 1999. The investigation centres on suspected use of Thai nationals as proxy shareholders in companies said to be ultimately controlled by foreigners.

The authorities said the inquiry followed earlier checks on Koh Phangan and Koh Samui in Surat Thani, and Phuket.

Three Pattaya targets searched

Investigators searched the KT International Law and Business office, in Soi Post Office, Pattaya Beach Soi 13, in Pattaya, which they suspect handled the registration of Cozy Beach View Co Ltd.

Officials alleged that staff from the law office had been named as shareholders on behalf of the company's real foreign owners. Documents and other evidence were seized for further examination.

The second target was Shilat Avenue Pattaya hotel, off Soi Buakhao, another legal entity which used the same law office for company registration. Investigators said employees of the office were named among the company's founders.

A deeper check reportedly found changes to the shareholder list linked to Lotus Paradise Development Co Ltd. Authorities also identified a shareholder with work history in the aluminium sales business in Samut Sakhon, which they said pointed to a complex nominee network involving several legal entities.

The third target was Cozy Beach View Co Ltd in Nong Prue, Bang Lamung. Authorities said an Israeli investor was a company director and that its shareholder structure appeared to have used Thai nationals as nominees since 2010.

Officials said there were significant director and shareholder links between Cozy Beach View and Lotus Paradise Development. The companies were said to have combined assets worth several hundred million baht.

What foreign investors should know

The raid is a reminder that foreign nationals cannot simply use Thai friends, employees or service providers to bypass restrictions on land ownership or business activities reserved for Thais.

Thailand's Foreign Business Act regulates foreign participation in a range of businesses. Using Thai nominees to conceal foreign control can expose all involved parties - including foreign investors, Thai shareholders and advisers - to investigation.

Authorities said the searches were conducted under court warrants to secure business documents and electronic communications. Computer equipment and documents were seized and frozen for forensic examination.

Waris said the Interior Ministry would work closely with the DSI to identify everyone involved and would enforce the law strictly. The officials stressed that the investigation remains focused on gathering evidence to establish relationships and conduct within the suspected network.

so it is not called investing ?

thailand prefers no investment than this fake scam of 49/51 they setup by not only lawyers, accountants, dbd, the land department that approved all of this

when I go to the land department , to buy a(nother) condo, they call the bank, every time, to check where my money came from, even it is printed on the bank's letterhead...

last time they even asked why I sent 1-2% more than the value

well, bad exchange rates and banks charging whatever extra's they can and giving you the lowest amount of baht for your euros or dollars...

Could it be that the Thai government needs the money to all of a sudden wake up and realized that : hey, we have been duped by all those farangs all those years, who now own all those prime properties preventing for Thai people a fair go''?

Something has triggered their response. I gave a few examples of what it could be, and the Thai economy not going so well was one of them.

Yes, there will be a market correction in property here, with future sales to foreigners taking a big hit.

Also, the flow on effect in the construction industry will not be pretty.

The same is true of prostitution, as has been pointed out many times.

There is no money to be made in chasing and eliminating prostitutions, as more than half of the tourists will not come anymore and you'll have ten of thousands of girls jobless.

Setting up companies and keeping books is not illegal.

It would have to be proven that the bookkeeper knows that they are participating in an ongoing illegal activity.

I agree- but the act of setting up the company- which company is there to facilitate an illegal scheme will be tricky to justify

The lawyer/s and / or accountant/s may even be the nominees.

In which case they may well have some difficult questions to face

Certainly I always refused any request from any client when I was asked to sit as a Trustee on any settlement or trust

The companies can originally be set up to operate as going concerns. They would not become illegal until it was clear that there was never any intent to operate as a legitimate business.

I imagine some are set up as traders and could actually make it look like the business is actually making money. They would not become suspect until they got lazy. If they used the business to launder money, they might never become suspect.

It's been reported that underware sales, amongst the expat community

in pattaya, have rocketed, shops are struggling to keep up with the demand.

Due to heavy soiling, by Thai nominee company, expat home owners.

It's basically the same operation.

47,000 Thai companies suspected of using nominees. Some would be for land / houses, some would be for condo's.

I use agents, and I agree. It's only a matter of time.

It's been a free for all here with land ownership and visas for years. Both have got out of control.

After that, it will be tax.

There are visa agents that just do hand-holding and they'll be fine.

Agents don't have to be raided for passing bribes. They can be raided for being agents.

It's not if, just when.

Whilst it's extremely lucrative for immigration, it allows people to circumvent immigration laws, and it's got way out of hand.

What makes you say it gotten out of hand? It does not seem like much of an increase to me. The way the price has plummeted it may be tapering off.

It's been allowed to compound, over decades, just like the Thai company nominee thing.

When's the last time you walked into an agent's office?

Or, it's flourishing, and there's a lot more competition.
