Revenue Dept May Seek Thaksin Bankruptcy Over Tax Debt

Thailand’s Revenue Department is intensifying efforts to collect more than 17.6 billion baht in tax from former prime minister Thaksin Shinawatra after the Supreme Court ruled that the department’s tax assessment was lawful. The ruling makes the tax debt immediately enforceable and opens the possibility of bankruptcy proceedings if the full amount cannot be recovered.

Somsak Anantawat, strategic tax collection adviser for the energy business group and acting director-general of the Revenue Department, said the case became final under Supreme Court judgment No 6890/2568, which was read on November 17, 2025. The court confirmed that the assessment issued by tax officials was lawful, leaving Thaksin liable for a total of 17,629,585,191 baht, including tax, penalties and surcharges.

According to Somsak, the Revenue Department continued pursuing the outstanding tax throughout the appeals process and court proceedings. Measures already taken include issuing payment notices, examining all categories of assets, preparing for possible seizure and attachment of assets, expanding asset-tracing efforts in Thailand and abroad, and coordinating with relevant agencies to enforce payment.

The dispute originated from a personal income tax assessment notice, known as Por Ngor Dor 12, issued on March 28, 2017. Thaksin sought to have the assessment revoked through the Central Tax Court, which ruled on July 18, 2022, that the Revenue Department had failed to issue a summons under Section 19 of the Revenue Code in his capacity as principal.

The Specialised Appeal Court’s tax division upheld that ruling on June 2, 2023. However, the Supreme Court later overturned both lower court decisions and ruled in favour of the Revenue Department.

According to the judgment summary, the Supreme Court found that Thaksin had concealed his ownership of shares in Shin Corporation Plc by having other individuals, including Panthongtae Shinawatra and Pinthongtha Shinawatra, hold shares on his behalf. The court found that the arrangement lacked tax morality, conflicted with the purpose of tax law, prevented proper tax collection and had no economic purpose beyond securing other benefits, including income tax advantages.

The court also concluded that the transaction was carried out for a seriously unlawful purpose and found no grounds to waive or reduce penalties and surcharges. As a result, the Revenue Department was confirmed as having authority to collect the full assessed amount under the March 28, 2017 assessment notice.

The Nation reported that if enforcement measures fail to recover the entire debt, the department will consider filing a bankruptcy case against Thaksin. A news report cited Forbes’ 2025 wealth ranking, which estimated Thaksin’s net worth at US$2.1 billion, or about 72 billion baht, placing him 15th in Thailand and 1,688th globally.

Thaksin will not pay, never. Thaksin is only a man who come to make money, not to pay. He only pays for his own good, like fake illness in prison and early releases... and in Thailand he seemed to be the most loved and successfull politician, but he is just a crook filling his own pockets

Here they talk about the possibility of that money could not be collected.

So it seems the crunch time is coming very soon.

And if he doesn't pay up what's his next move.

Reports seem to indicate he barely survived his recent stint in a standard cell sleeping on the bare floor at klong prem, and after release he was pretty shaky, so have they got the private jet (located just across the border in Cambodia)ready for a long flight to Dubai. And are they enough funds still located in Dubai to pay the Dubai villa rental for the rest of his life?

As a smaller point where's yingluck?

Forbes said he has 2 billion USD (his worth anyway). I was thinking about Yingluck too. Just a couple of months ago there were rumours she'd also come back. Is she in Dubai or UK? Anyway, the writing's now on the wall for the entire clan. I'm not surprised. We know who controls the courts (and punishments). They'll all have to leave. I can't imagine they have much hard cash in Thailand. Just what they need. The rest will be real estate.

As I recall , Yingluck still owes 5 billion B.

Not just Thaksin, but the whole Shinawatra family should be closely examined.

They have been involved in shady business deals for years

Even their domestic servants have been used as nominees to hide their wealth.

This corrupt clan belongs in the dustbin of Thai history.

Just imagine the party they throw when they all get their handouts. This has as much chance as the working party becoming the next Thai Government.

I've been living in Thailand for the past 25 years and I don't care about Thai politics. I worry about my wife and myself. When Yingluck got the flick my exchange rate was 33.5 baht to the Aussie dollar. It's now around 23.30 thanks to the military coup and it's hardly increased since then. I remember when the UK pound was 84 baht.

Me too. Long time here. Don't really care about the politics, but it's clear the same group of people that represent the elites/establishment keep getting into power and the courts/authorities seem complicit in ensuring that. This stranglehold is what keeps things sweet for the wealthy and well-connected while everyone else struggles. Many posters on here have said the THB is kept artificially low (strong) for the rich overseas Thais and those investing abroad from Thailand - it takes fewer of their baht to buy/invest anything in hard currencies. I remember a high of 44 to the USD and 77 to the GBP. There is no logical reason for the THB to be as strong as it is now, with the economy in such bad shape.

At that time the AUD was high against a number of currencies.

Some limited truth in what you wrote but that doesn't change anything about the honessty / sincerity etc., of the shin clan.

Thaksin went bankrupt in his initial business activities but was then handed a telecoms license by a rogue general who was one of 3 rogue generals who conducted a coup and one installed himself as the PM.

At that time it was Thai law that ALL telcoms activity must be conducted / controlled / managed etc by a dedictaed government agency.

The rogue general ignored all of that and with no flags flying handed a license to Thaksin. No bids were taken. Thaksin charged outrageous fees to use his telecoms system and outrageous fees to buy phones from him (not available elsewhere).

Thaksin knew well that he was handed a gold mine and he used it to generate infrastructure (but some paid for by the state) and ealth. on Thaksins part no ethics or morals in the picture.

What do you expect ! if you have lived here a long time you should have learnt every man and his dog are corrupt it is a way of life here all you should ask is how deep the corruption is as for Thaskin he is not only a felon he is truly an evil man!!

Re the land deal: I recall well the TV news videos when all concerned signed the deal for thaksin / pojaman to buy large amount of state land, I also recall thaksin waving the signed sale documents if the faces of the senior beaurocrats assembled close to the TV news cameras, all of them with way less than happy faces. They knew well that they had just witnessed an illegal land sale.

Sure corruption is still rampant in Thailand while other regional countries are making progress to reduce corruption. Vietnam is one example and just recently Vietnam made a number of changes to official appointments bringing in new thinking attitudes with a real desire to progress.

Over 10 years I taught many executive MBA programs in Ho Chi Minh City and Hanoi in English, most classes about 25 to 30 students. All the students were impressive, all spoke and wrote perfect English, all asked value added questions and I always promoted cross discussion in every lecture. I noticed more and more a stronger grasp of analysis and desire to world class.

One of my students went on to be the Minister of Education of Vietnam. He came from poverty but as a small child embraced a strong desire to learn Enflish.

He found numerous large scholarships to good schools / universities in Singapore. He was the driving force to make big changes to Vietnam's education policies and objectives.

And the results are evident today.

Not just Thaksin and the Shins, but also current and past key government figures, including PMs, in particular among those who opposed Thaksin and/or ousted him. Of course, it won't happen as they are part of the same network as the Judiciary.
