I want to divorce my Thai wife as I have returned to Australia and do not intend going back to Thailand. Can a Thai based lawyer do this through the courts without me being there.

I would imagine a Thai lawyer can act on your behalf via a "Power Of Attorney" but the final court appearance is in person (if the other party does not agree). All of the Thai lawyer websites (siam legal etc) have information about the process and POA.

It comes down to if the wife is available, cooperative, then a lawyer can represent you at ampher. If the wife is unavailable, not cooperative then it goes to court and you need to appear in person.

Thanks Peter, the link was what I was looking for. It would be ideal if she was cooperative and go to ampher but can't see that happening.

Calm down, come up with an equitable solution for both you and your wife, find cooler minds to work as mediators, then file for divorce at the local amphur where your were your marriage was registered.  You both will come out ahead.
