Can my Thai daughter be denied at the Thai land border ( she's use EU passport and already had 2 land borders in 2017 )

Hello, my Thai daughter who using her EU passport she's already had 2 land crossing border to Thailand on 2017. And there's already wrote (1) and (2) at the both of stamp land crossing

 

We gonna pass to Thailand ASAP via / Koh Kong border.

 

I have the copy of her Thai birth certificate ( and copy tabian baan ) 

 

Is possible she being denied of entry ( even if in the law they said that a Thai citizen cannot be denied of entry in Thailand )

 

 

I am afraid the IO will don't accept her entry

They can definitely deny entry to her using her EU passport. Whether they will is anyone’s guess.

 

They can’t deny her entry as a Thai, but I’ve no idea what documents they will require to let her pass.

 

Next time she enters using the EU passport go to Immigration and apply for a 1 year extension of stay and a multi entry re-entry permit, or buy singles whenever she leaves. That will get over any future problems if your going to stick with using the EU passport.

entering on a foreign passport she will be treated as the rules per that nationality.

 

The obvious question is why she doesnt't have a Thai passport?

 

In any case, when she re-enters, Thai nationals and former Thai nationals can apply for a one year extension of stay for her in her EU passport based on her thai birth certificate. Get her a re-entry permit (or muliple re-entry if she if following you on border runs) and she can come and go as she pleases then.

I would not expect special leniency for a dual-national.  My suggestion would be for her to fly-in, to get around the 2-max rule, then get a Thai passport.  Then, she would need to fly in again, to switch to using her Thai passport to enter Thailand.  If more time is needed for this, do the 1-year extension + re-entry permit on the Euro passport.

If she is Thai she is required to use her Thai passport to enter Thailand. That's the rule for dual citizens. I guess it is up to immigration officer to make final decision if they let her enter on a foreign passport. Better not tell them she has both citizenships.

Not required, but a good idea if one plans to stay awhile.  It avoids exactly this situation.

It would be hard to hide, with nothing in the system of her (as a Thai) leaving the country in their system.  So, I don't think they will let her enter by land with the EU passport (2x rule) - and she doesn't have a Thai one.

I’m pretty sure there is no such rule. Do you have a link to anything that could confirm that.

why do people and not just the op, allow Thai family to enter Thailand on a foreign passport, there is no logic or advantage to this. it can only allow problems to arise, as is the case in this thread, get a Thai passport and use that to enter. but to swap passport it has to be done at and airport not at a land crossing

I actually agree with you that it would usually be better to enter Thailand using a Thai passport. There can, however, be cases where this is undesirable. For instance,

  • if your minor child enters Thailand using a Thai passport, there can be complications leaving. Generally, if the child is not leaving with both parents, proof must be provided that the non present parent(s) agree to the child's departure;
  • for a male up about age 30, it may be safest to ensure you are never entered in a house book in Thailand. If you are, you become eligible for the conscription lottery. To get a passport in Thailand, you need to be in the blue house book.

Because there's also more complication to use a Thai passport for a Thai kid

 

Her mother won't take care of the kid, and she disappear.

 

1. I don't have contact with her Thai mother, I can't apply any kind of Thai passport for my daughter, that's Thai law, as father who was not married / or don't have any custody on the kid, we don't have any legal rights to apply a passport

 

2. Even if carry a Thai passport, there's a big possibility that the IO at the airport, they will deny that the kid leave Thailand, there's many reports on this sense. Because it will always need a conscent from her mother etc.

My children never enter Thailand using Thai  passports because there’s no need and it avoids messing around swapping passports.

 

If they stay longer than 90 days it’s easy to get a 1 year extension of stay, if necessary.

 

IMO all the time they’re under 15 there’s no point in applying for a Thai passport that’s only necessary to enter a country they have a legal right to live in anyway.

Actually, the rule is that you are supposed to show both passports when entering one of your countries. I doubt too many people know and do that .... as long as the IO doesn't know nobody cares. Propblems arise when customs inspects your luggage and finds 2 passports ... My mom is a dual citizen and ran into that problem a few years ago. She was lectured and told they could have fined her.

Again, I don’t believe there is such a rule. There is no law compelling my dual nationality children to have a Thai passport. And they cannot be prevented from travelling out of Thailand using their British passports. So your “rule” is impossible to enforce.
