PM says never uses Article 44 to intervene in justice system

BANGKOK, 15th January 2018 (NNT) – Prime Minister Gen Prayut Chan-o-cha has confirmed that the government and the National Council for Peace and Order (NCPO) have never invoked Article 44 of the interim constitution to influence a court decision. 

According to the prime minister, Article 44 of the provisional charter is only used for four purposes: reform related matters, national security, public security, and drug prevention crackdowns. 

Though Article 44 is equivalent to a special law, Gen Prayut confirmed that it has never been used to intervene in a judicial process or manipulate a court decision, adding that the law is only enforced out of necessity. 

The NCPO last month decided to exert its power under Article 44 to make changes to the Organic Political Party Act, giving political parties more time to update their status and membership, and prepare for a general election.

Interpretation of encompassing words will go round and round and the argument to use article 44 in any situation will be bogged down after the fact of implementation.

Yes, that's the whole purpose of Article 44 - to bypass judicial process.

Criminal Justice System as defined by Oxford Dictionaries:

"The system of law enforcement that is directly involved in apprehending, prosecuting, defending, sentencing, and punishing those who are suspected or convicted of criminal offenses."

Prayut presents the justice system as solely the trial in court and court sentencing. It's not.

He uses the absolute power of Article 44 to conduct searches and arrests without court warrants, secret incarceration, removal of elected officials and police without due process of law, delay statue of limitations, violate laws, remove judges through redefinition of qualifications, and allow trial in absentia.

In all fairness though, that is the way politics works in many countries.
