DEPUTY Prime Minister Wissanu Krea-gnam yesterday suggested a legal option regarding the confiscation of former prime minister Yingluck Shinawatra’s assets, saying she still had a chance to ask for a court injunction to suspend the enforcement of the law.

 

While the Administrative Court on Monday rejected Yingluck’s request for an injunction against the administrative order, which in effect allows authorities to resume the seizure of her assets, the former prime minister could have her lawyer submit a new request, he said.

 

Of the 30 assets listed in regards to the issue, the confiscation of her Bt110-million mansion in Bangkok could be delayed if she could prove it is a marriage property, acquired after her wedding, and had to be shared with her husband, he said.

 

“People who are living in the house can stay on, but need permission from authorities or have to pay rent,” said Wissanu, a government legal expert. 

 

Yingluck’s lawyer Noppadon Laothong said earlier her mansion in the capital was among the assets that had been confiscated to pay the compensation demanded for damages stemming from her government’s rice-pledging scheme. The Legal Execution Department, which is under the Justice Ministry, in July last year started freezing the ex-premier’s bank accounts and placing liens over several of her properties. 

 

Among her assets are 10 land plots in Bangkok and the provinces, her mansion in Bangkok’s Soi Nawamin 111, a condominium suite and 13 bank accounts with total deposits of more than Bt1 million. 

 

In a financial report submitted to the National Anti-Corruption Commission, Yingluck estimated that the mansion, where she had lived before fleeing the country last August, was worth Bt110 million. It was the highest-valued item among her reported assets. 

 

In October 2016, the Finance Ministry issued an administrative order for Yingluck to pay Bt35 billion in compensation for damages allegedly stemming from her government’s corruption-plagued rice-pledging scheme. Yingluck was held responsible for the damages in her capacity as government head and chair of the National Rice Policy Committee.

 

Yingluck fled the country a few days before the Supreme Court’s Criminal Division for Political Office Holders was scheduled to deliver a verdict in a case against her in the rice-pledging case. A month later, the court sentenced her in absentia to five years in jail for negligence. 

 

She was later spotted in London around the New Year holidays. Asked if the government could auction Yingluck’s confiscated properties, Wissanu said it could but the Legal Execution Department has decided to put the idea on hold since the ownership of many assets was still unclear.

 

“Her lawyer might make another appeal to suspend the confiscation. There are |people living in the house. We cannot just force them out,” he said.

 

“We will enforce the law properly and accordingly, not desperately.”

You have to ask yourself why they would do this ?

 

Why ?

 

They've just deliberately destroyed the person who won the last election in Thailand and they will now need the votes of the people who voted for her to have even the slightest chance of winning anything.

 

That's why they will backtrack on this issue....

LOVE IT  13 bank accounts with 1 million baht in them, smart lady, us poor farangs have to have nearly that amount in our accounts for 3 months ha ha,

Thai government should take note how they do it in Saudi Arabia . At this rate the 35 billion will neven be recovered. Shame on Prayut for letting her "escape" .

If any of Yingluck's assets are community property, by what right under Thai laws does the government claim 100% control?

If that is an option under the law, why is it called a "lifeline?"

So her attorney files the prerequisite claims. What's changed?

Now an offer to suspend her entire sentence and immunity from any other charges related to her position as PM and Caretaker for her voluntary return to Thailand would be a lifeline.

Wonder if any of that money is paying for what's his face's names 25 watches, just asking ?

No, let the denials go on and on. It shows they are reacting to current events rather than shaping them.

They have two options now it is evident they wish to hang on to power: Declare themselves as a bona fide military dictatorship and f- you, or take a gamble and hope their constitution and senate gerrymandering will hold after an election. Right now they don't seem all that keen on the latter option...

You can't blame her for being born into wealth and declaring it all, what about what's his face, how much is he not showing from all the kick backs off of the subs, aircraft's purchased etc etc

Are "Village Weddings" given the same rights as full legal signed at Amphoe weddings under Thai Law?

 

I wonder if they are treated differently? Does property acquired since and during the marriage, if a village marriage only, attract the same rules. Presumably the DPM thinks so, otherwise the wouldn't be giving this alternative.

Born into wealth - and totally unconcerned about how it was acquired. Declaring it all - so you think the billionaire Yingluck has declared all her overseas assets and cash accounts? 

 

If they really wanted to be spiteful, as some posters insist, then they might check if she paid duty on all those pearl necklaces she was photoed buying in China with big bro.

 

Reality - they're all at it. Always have and always will. And she made a pile from doing as her brother told her to do.

Village weddings are not recognised at all by law as far as I am aware.

One thing you may have overlooked, i.e. they gave to the needy as well, kind of modern day Robin Hoods if you like, as opposed to the Junta, who are all for themselves and the yellow's IMO.

A few crumbs, now and then. And kept the biggest, very biggest, slices for themselves, family, extended family and cronies. 

 

They're nothing like Robin Hood, more like the Robber Barons! 110 million baht mansion, jewels, designer handbags worth millions of baht, private planes etc etc. Just newer on the block and without the backing of the military. If they had the latter, they'd have been exactly the same as this the older established elites.

Nothing spiteful - just reality. And btw, it would be the customs not the tax people who collect duty. Do you think, when her private plane landed at Dong Meuang, and she waltzed through the VIP channel to her waiting limo she stopped to declare things and ensure appropriate duty was paid? Or even had a minion do that?

Well...you know...we are constantly told by 20 year veterans here that Thai politics are somewhat subtle and composed of many layers tho' I can't say that I have ever seen any evidence of Machiavellian  intelligence on display, personally.

 

Maybe they want her to throw 'em a lifeline?

 

They really,really,do need her help.It is quite possible that even their own mommies have given up on them.

Even with the couple of extra votes they may get they will NEVER have enough votes to be legitimate! :shock1:

There is no doubt they did give to the needy - indisputable fact! unfortunately for the wrong reasons, they did it for political gain, which in the grand scheme of things is not so bad, the 'others" gave nothing!

I too am a guest here - a paying guest - so expect to be well fed :smile:

I don't hate anyone but I do dislike corrupt lying self enriching entitled politicians. And let's stop pretending, she and her clan are no different. Why some posters insist that she's somehow innocent, honest, and like her brother never ever done anything wrong is up to them.
