Hello All

I have had a work permit with the same employer for the last 8 or 9 years. Every February/March my employers lawyer/accountant provides me with paperwork to apply for a 1 year multiple entry non-b visa. I have always gone to Peneng and used Banana Guesthouse to make my visa application. I have never had a problem. 

I have now heard that I may not be given a visa from Penang. I do not know if I am listed as a director or shareholder of the company or not. What would I and my employer need to do to have me listed? If I am not a shareholder or director and I use an agent is there a chance I will be given the visa or is it a definite no?

What other options do I have? Can I get a 1 year single entry non-b? I have heard I can get a 3 month non-b and extend it for 1 year. How do I do this? Can I extend it on arrival in Bangkok like a tourist visa? Do I need more paperwork for an extension?

What does everyone else do in this situation? There must be thousands of foreigners legally working in Thailand who are not directors or shareholders of the company that employs them. 

Any help or suggestions would be appreciated.

If you are not a owner, director or shareholder you will not get a multiple entry non-b visa in Penang now.

You can apply for apply for a one year extension of stay at a immigration office during the last 30 days of your current 90 day entry from the non-b visa you have now.

Not mentioned in the requirements is that you must have meet a minimum salary requirement. It is 50k baht for those from most western counties.

I'm in the same boat, except that I've been in the same job for 13 years.

Suddenly - no 1-year visa anymore.

It's the last straw.

The govt don't want smart-a** whities here any more, with their superior education and skills - just Chinese tourists.

After 21 years in Tland, I'm off to a country which welcomes white people.

There must be thousands of people all over Thailand, that are working legally, who are in the same situation as I am in. 

 

Good luck Rob. I guess you are on Koh Samui. What about the German guy, Herbert, I think his name is, who organises visa runs from Koh Samui? Can he help with an application in Kota Bharu?

Yep - the legendary Herbert - but he can do nothing as this is now the rule throughout all Thai consulates in Malaysia - although I can't speak for other countries.

 

All you can now do is what I'm having to do - get a 3 month visa, then inside the last 30 days apply to your local immigration dept for an extension of stay. I'm told it's a HUGE process, with lots of to-and-fro to govt offices and reams of not just paperwork but also original company documents being submitted - they even want an authenticated photo of you doing your work in your workplace!

 

Richard Attenborough once remarked that the progress of a developing society can be measured by the complexity of its bureaucracy. Primitive societies don't have any - emerging nations have far too much because it makes them self-important and like they are a real nation - and sophisticated societies have comparatively little because they have gone on to become streamlined and efficient.

So, just to clear this up in my head.........

If you are legally working as a teacher with the correct visa and WP, you still need to do a border run every three months. Unless you earn 50k+, in which case you can get an extension of your visa for the duration of your contract.

Do I have that right?

Teachers are exempt from the salary requirements.

Extensions for teaching is under a different clause of the police order. There is no minimum salary  for a teacher.

For extension of stay at immigration on Samui, you need the same paperwork as for getting a non-B visa in penang. 

But you need also show tax and social security payments for four Thai employees, and two year audited company balance. 

 

Basically the only thing that made the penang annual non-B visa run from Samui is the lack of Thai employees that pay taxes and social security.

Also no minimum salary to get the non-b visa.
