Hello Forum Members,

 

Could someone please tell me the rules for obtaining a work permit with a BOI company if I am currently on a Non-O one year extension based on marriage?  Can a BOI company get me a work permit on the visa that I'm on? 

 

Any official references would be appreciated.

I can only tell you my experience a good few years ago.

I was on a multi O based on being married and started work with a BOI company.

The company took to the centre in BKK and I had an extension issued by them along with a 2 year WP. At the the time the company still had 2 years left of the three under BOI rules/conditions.

I resigned after 3 months and had to go out and get a new multi O.

So by what you are saying you were able to obtain a work permit from BOI while you were on a Non-O.

 

Were you on a one year extension at the time? 

 

When you resigned did you still have a Non-O?  And before resigning did you try to present 40K per month income or 400K in the bank?  Maybe if you would have done this before resigning it would have saved you a trip out of the country.

They changed my non O to a B extension and issued the WP based on that.

When I resigned I lost both obviously and left Thailand to get a new multi O visa within a day of resigning.

Odd thing was when I flew back in the IO commented that the B from BOI hadn't been cancelled but I chose obviously to use my  new multi O.

I think the BOI will change your multi O when they issue your WP.

Ref presenting the 400K or income I doubt that would have worked prior to resigning.

The BOI WP is tied to your BOI extension. It eould just cause confusion and problems. BOI WP issued for 2 years wouldn't be supported by a one year visa or extension.

i've had similar situation with BOI in Chamchuri. Try to stay on your non o as that will be valid even if you wish to leave the company. i am sure you can get WP and extension from BOI on Non O, and i wanted BOI extension on my non o but the company didn't.  if it's an extension from BOI on a biz visa then you need to leave once your job ends but if you do on non 0 it's still valid then you can go from there.

that's how i remember it anyway. wait for more advice.

**boi have different rules i think and my company a few years ago just wanted me on biz for control so they could well have lied to me.

Thanks for the contribution.  I'm looking forward to hearing what UJ has to say as well.

 

The main reasons I want to stay on my Non-O is because if I end up quitting, I wouldn't have to do the entire visa process over again.

 

Another thing that concerns me is my national government health care I've been paying into every month since leaving my previous job.  

 

Would I automatically end up ineligible for benefits?   

 

I'm starting to think there are some disadvantages to having a Non-IB

I'm, from memory, pretty sure you don't have a choice. I had the same experience as you.

I have seen several reports of the one stop center for BOI companies insisting it had to be a non-b visa to the get work permit and extension of stay.

If they changed you to a non-b visa and a extension of stay based upon working you could change to a extension of stay based upon marriage without leaving the country if you had the financial proof to do it when you left your job.

Starting work would not end your social security health benefits. It would be changed to the standard social security payment deductions and then if you left work you would have to apply to continue it again by paying the monthly payments yourself.
