Is a work permit required serve as a committee member in a housing committee (Juristic Person)

Can a foreigner serve as a committee member or be the Juristic Peson Manager in a housing estate (mooban) without a valid work permit ?   

You can attend the committee meeting without a work permit.  It is about the same as being a director of a company and attending meetings which is allowed.

Signing certain documents though could put you over the line though.

You absolutely need a work permit to be a JPM. Of that I'm completely certain.

It's more a matter of how important, likeable you are and who you know up higher in the chain.  I've seen people do well,  get fined and knocked off motorcycles. Not worth the risk if your a Mr Nobody like myself.

For being a member of committee no WP required.  To be Jurisitc Person Manager you would need a work permit.

I think you are right if taking on duties of building manager by yourself also but if employing a thai to perform those duties it's been pointed out to me that by order of HRH in the thai condo act it's ok to be Committee member and Juristic Person if you are a co owner. Unfortunately,  thai condo act doesn't appear to be enforced.

Any documents that order work, or approving expenses etc  ! You may never get into trouble, but if there's just one snitch with a dislike for you...It has happened, but not often...

True, many years back in my old condo in Bkk this was explored thoroughly because many of the Thai owners were totally dissatisfied with the antics of the then current committee, mostly meaning Chinese Thai who outnumbered the Thai owners on the committee.

 

Bottom line - the Chinese Thai voted down any move to do even simple maintenance work. At an AGM these was serious discussion about the need for major replacement of the now old pool equipment, some 100,000Baht , per unit around 1,500Baht. 

 

The pool was big and attractive and well used and on the same level a nice gym and table tennis room. The loudmouth from the Chinese Thai bloc pushed for a vote to just close the pool and everything on that floor, put newspaper on the inside of the doors to the pool floor /area and stop all forms of maintenance to that area and also stop all cleaning activity etc.

 

Also the pool equipment was leaking and had damaged the floor of the equipment room and walls under the floor, and was leaking down to an occupied condo below. 

 

Fixing the damage caused to the occupied condo below was also discussed, Chinese Thai bloc tried to get a vote to say 'no compensation - just bad luck'.

 

At this AGM there was uproar. A new owner (a respected Thai businessman) demanded to speak, he suggested that there quickly be another meeting to take a complete new vote to form a new committee and he also recommended that several farang owners be requested to join the the committee, including a well known engineer. Ultimately there were 3 farang on the new committee.

 

Then the discussion about WPs. The new Thai owner got his lawyer to investigate and the lawyer spoke at a further quick AGM. His comment was that being a committee member and contributing to discussion did not need a WP. Counter-signing meeting documents did not need a WP.

 

Being closely and regularly involved, especially financial, payments, banking documents did need a WP.

 

Lawyer also made the the that the designated Juristic Person position was a different subject, it could be a farang and the farang would definitely need a WP.

Did he quote any laws that can be checked? People tend to say a lot as fact that can't be checked.  Only accept that can be checkable.
