I was going to ask an attorney to prepare a loan contract and asked if it would be legally enforceable if we were to default in the event of divorce. The attorney said: ‘’it would be legally enforceable in court, if you can prove that the money you are going to lend her is "Sin Suan Tua" (Separate Property) . If this matter arisess going to be litigation issue and you must provide sufficient evidence. ‘’ How would I provide this evidence in the above mentioned circumstances.
