January 26, 200719 yr We live here with two kids (5 years and 6 months) on 1 year Non-Imm. B and have to make a re-entry every 90 days. I don't think its easy for the kids (especially for 6 months old one) to make a trip to Combo. Some sources say that there is no penalties for children under 7 years old. So we decide to make them permanently overstay. Have anyone done this before? Will be there any problems?
January 26, 200719 yr Below7 years there is no charge/penalty for overstaying children. However this is Immigration Policy. Your child might not be admitted to a school if they are on lengthy overstay. Why take the risk.
January 26, 200719 yr I have no personal experience but there has been recent comment on this forum (not too far back) that overstay is waived for children upto 14 years. But you are talking of some overstay.
January 26, 200719 yr A very grey area. Your kids are not responsible for their actions, but you are. If immigration chooses to raise the issue when you want to depart what are you going to say ? "The kids didn't want to go ?" This is not a few days we are talking about. Personally, I think your taking the P**s if you do this, what I think doesn't matter but if the immigration officer is of the same opinion expect a problem. If you take this route make sure you check in for your home flight very early, and with a lot of cash.

January 27, 200719 yr There is absolutely no problem with children overstay on the part of Immigration. The are not going to arrest anyone.
