THE MARRIAGE of a Malaysian man to an 11-year-old Thai girl in Narathiwat province has clearly violated various Thai laws, a former UN committee member on the Rights of the Child said yesterday.
 

Sanphasit Koompraphant urged the police of both countries to take legal action against the 41-year-old Malaysian man immediately.

 

He was responding to a report that the Malaysian man had gone across the border from Gua Musang in Malaysia’s Kelantan to the Sungai Kolok district of Narathiwat province in Thailand to have the marriage solemnised with the Thai girl.

 

The man, whose name has not been revealed, already has two wives and six children and is said to be the imam in a village there.

 

His children are said to be between five and 18 years old and one of them is even friends with the girl. The young bride has never been to school. It was reported that he had exploited loopholes in Thai laws, as it is illegal to wed an underaged child in Malaysia.

 

The Star reported that the parents had agreed to the marriage but had imposed a “condition” that their daughter would only be allowed to live with the “husband” when she turns 16.

 

The case became a hot topic in Malaysia when the man’s second wife posted photographs of him and the girl and their alleged solemnisation ceremony.

 

Sanphasit said the man would have committed a criminal offence if he had sexual relations with a child under 13-15 years old. “The act violates the law as he would be considered as raping the child under 13 years of age, no matter with or without the child’s consent,” he said.

 

The punishment is more than 10 years in jail.

 

According to Sanphasit, many wrongly believe that in the four deep South provinces of Thailand, Islamic laws on family and wills that allow such a marriage could be applied to this case. He said Islamic laws could apply only in a civil case, not a criminal case like this.

 

He called on the police of Thailand and Malaysia to arrest the man and have him extradited to Thailand to face legal action.

“Apart from committing a serious criminal offence, the man could be charged with child abuse under the Child’s Protection Act.”

 

Referring to reports that the girl’s parents had permitted the marriage or even were present at the ceremony, Sanphasit said that they, too, would be considered to have committed a crime for allegedly failing to properly raise their child and exposing the child to the risk of becoming pregnant before the proper age.

 

“If the parents received endowment from the man, they would have violated the anti-human trafficking act as they would have handed over the child to wed the man for monetary benefit.”

 

The Malaysian believes that he has not committed any offence under Islamic law as he had sought advice from religious authorities in southern Thailand.

 

Malaysia’s Deputy Prime Minister Dr Wan Azizah Wan Ismail said recently that the marriage was illegal because the marriage had not received the consent of the Malaysian Syariah court as the girl was under the minimum legal age for marriage. 

 

According to the Malaysian Islamic Family Law Enactment, the minimum legal age for marriage is 18 for a male and 16 for a female.

 

National Human Rights Commission member Angkhana Neelapaijit said that this was not the first case, as Malaysians who wanted to wed an underaged girl usually came to Thailand.

Oops, my mistake, he's muslim, therefore has a law especially designed for his pleasure. The sad thing is, society seems to agree with that.

Any religion that promotes pedophilia really need to be rethought and brought in line with present day laws and morality.  Wedding, no less bedding, a prepubescent girl is unconscionable.  What may have been accepted in the 7th Century AD is not acceptable now.

I always find it interesting why all Muslim men are immediately grouped as paedophiles due to one. With all the stuff coming out in the west, how societies and organisations have protected paedophiles for years due to their status, we still don't go out and say all westerners are paedophiles. 

The argument about the holy books is interesting too. Didn't the bible also have passages that approved paedophilia? That is was okay to kill the woman and the men who laid with them in war, but keep the women children to yourself. 


There may be an argument that we have moved on from that? But have we? Look at all the cases that are finally coming out. Look at criminological surveys and crime stats in countries that are not Muslim. In the US, for example, 1 in 5 girls are victims of child sexual abuse. 1 in 20 boys. Children are most vulnerable to child sexual abuse between 7 and 13 years of age. 28% of 14-17 year old have been victims of sexual abuse. I am sure it isn't too different in Europe, Australia, Canada etc. Some cultures have rules that may approve it, other countries have rules that do not approve it. However, it happens frequently in both places regardless of what rules are in place.

This is not a support of paedophilia as I am sure the bored TV members will come and say.

It allows them to control everyone else, has nothing to do with religion, it is based on sex and control of females as well as younger males. Promoting rape/enslavement of non muslim women as well as the killing of anyone not of their faith it is easy to see this was created by a desperate male that simply wanted to be able to do as he pleased

I would not say that all Muslims are pedophiles, in the sense that we hear.
But, of all time, they have always been very focused on sex and the older they get, the more they take young children.
I would say more than it is perversity, in the broad sense of the word. .
Moreover, they always need virgins whom they force the evening of their marriage, with a humiliating, abominable ritual.
Which means domination over the woman who is less expensive than a sheep.

Well done. 

It is one argument to blame the alleged perp, yeah, lock him up but what about the Thai authorities who usually are ineffective at anything including general deterrance, or the parents who sold thier daughter. The perp is not the only guilty party here, everyone, one way or another needs to learn that a 11 year old child is just that. She not something to sell and is not something that can be bought. We are all born to be free.

I am in no way condoning sex with kids, but you have to have some historical perspective about this.  Age of consent has only very recently hit the ages we see now despite sexual maturing occurring sooner (better nutrition and health environment) .  Given that age of consent in the US is now way older then when kids become sexual beings, it is causing many problems in the US for normal sexual behavior from even when I was a kid (70's).  There are mid-teens now with felony records and on sexual predator lists for the rest of their lives (basically making them unemployable) for acts that, if caught during my time, would have meant a meeting of the parents to make sure every one understands what happened, and a caution that the parents should keep a closer eye on their kids.  This shows the difference in the application of laws from when I was young to the present day.  The application when I was young was based on common sense of the police officer in front of you, now it is the law period.

 

Anyway, using the US as an example on age of consent:

 

"While the general age of consent is now set between 16 and 18 in all U.S. states, the age of consent has widely varied across the country in the past. In 1880, the age of consent was set at 10 or 12 in most states, with the exception of Delaware where it was 7.[2] The ages of consent were raised across the U.S. during the late 19th century and the early 20th century.[3][4] By 1920 ages of consent generally rose to 16–18 and small adjustments to these laws occurred after 1920. The final state to raise its age of general consent was Hawaii, which changed it from 14 to 16 in 2001." Wikepedia. I am a Dad with a teenage boy and girl.  We have spent a chunk of time with open discussion of their sexual maturation over the years.  There is not anything they can not talk to us about.  We are considering a move back to the US but are very concerned about the criminalization of kids we see in the States.  We are also considering Germany (age of consent 14) which seems to have a more natural logical approach to this subject.

 

Around the world, most countries have the age on consent as between 14 -16.  Spain (almost all beaches nude OK) just recently changed theirs from 13 to 16, the PI is 12, Japan 13 unless local laws designate higher, some places illegal until married.  Different cultures, different rules.

 

From the dialog in what has been reported, it seems the guy has married her with a binding agreement with the family, but she will not be in his household and sexually active with him until she is 16.  Arranged marriages are still commonplace in a good chunk of the world.
