Hi,

 

I have tried to find information online but I don't seem to be able to get a definitive answer. How many, if any, paid personal leaves are granted by law? The company lawyer told me that this is fully up to the company and that the law doesn't specify any amount. Is that correct?

Well the company should change its lawyer then, as they obviously dont have a clue section 30 of the labour act...after 1 year..minumum of 6 days

Thanks for the replies, but I think you guys are referring to Annual leaves, not Personal leaves. Section 30 says:

An Employee who has worked for an uninterrupted period of one year, is entitled to annual Holidays of not less than six Working Days in one year, and the Employer is obliged to fx the Holiday in advance for the Employee or as agreed by the Employer and Employee. In the following year, the Employer may fx annual Holidays for the Employee of more than six Working Days. The Employer and the Employee may agree in advance to accumulate and postpone any annual Holiday that has not yet been taken in a year to be included in the following years. For the Employee who has not completed one year of service, the Employer may set annual Holidays for the Employee on a pro rata basis

Define personal leave then by example ?

 

If you mean personal days on top of your annual leave, then the lawyer is correct..any personal leave comes off your annual leave allocation, excluding proven sick days

Doing government or similar related paperwork like renew ID card or passport and the likes, or embassy related stuff for us expats.

LOL most definitely comes off your annual leave...no the law doesnt address things like this, and most certainly doesnt allocate days...the lawyer is 100% correct...you want days off for this...comes off your leave

Sorry, misunderstood your op.

 

If the Thai s gets personal days to renew id card s etc then so should you, if not then as said it's off your annual leave.
