Question: Can a One Year Extension of Stay (extended from a B Visa) be allowed to just Expire without canceling it by being out of Thailand on the date of Expiry and the day after Expiry?

 

Current Status - I am the Mananging Director of a Thai Registered Company (not a BOI Company).  I have a One Year Extension of Stay - from a B Visa.  The Extension Expiry date is 12 Dec 2018.  I have a two year Work Permit.

 

I want to change to a Non Imm. One Year B Visa - Multi-Entry  in Penang or Kota Bharu, Malaysia.  I have researched this and know it can be done in either Thai Consulate.  Plus, I have all qualifying documents for the One Year B Visa ME or for the One Year Extension of Stay.

 

Changing to the one year multi-entry B Visa will be helpful to me in 2019 

 

For reasons I do not want to discuss, I just do not want to go to Immigration -- cancel the Extension of Stay and then be hurried out of Thailand.  I just want the Extension of Stay to Expire on its own accord.

 

What I plan to do (with a reentry permit in the passport) is to cross the Malaysian border into Kota Bharu on 12 Dec 2018 (the Extension Expiry Date). Then on the morning of 13 Dec 2018 (Extension Expired) I will apply for the Non Imm B Visa one year multi-entry at the Thai Consulate - get the Visa the afternoon of 14 Dec 2018. Then return home.  Next visit Thai Immigration within 24 hours - report returning from being out of Thailand and report my new Visa Status.  Then be done with Immgration for most of the next year.

You can do what you wrote about.

The only time you could have a problem is if you want to apply for another extension later immigration could want the extension formally canceled before they will accept the application. There have been reports of few offices requesting that be done.

Thank you Ubonjoe. I have read many posts on this subject on various venues.  Some got into to trouble including overstay.  But they really pushed the limit.  Typically a teacher quiting a job leaving Thailand with 5 to 6 months left before Extension Expiry.  Then returning before expiry and were stamped in by an I/O under the same Extension.  Others did not leave until months later but but finally just before Expiry.  The stories run the gamut.  I hope for it to be seen that I left with no intention of applying for a new Extention,  the Extension expired, not using any days after expiry and returning with a new visa with no possible confusion about stamping me in under the new visa.  I will immediately report within 24 hours of returning with a TM30.
