Hi all. Need some useful information and help. 

 

Im currently based in Bangkok. I moved here last year and worked smoothly for 5 months. Then something  bad happened and company asked me to find a new job. They said they will provide me the visa (non B) and work permit until I get a new job. Currently I got a new job and I want to know some important steps

 

1) what should I do with my current visa and WP (my new employer asked me to apply for non B in my home country) 

 

2) I was paid only first 5 months. So what should I do to clear the tax issue. What if the company dint pay the remaining months? Any penalties?

I don't think you have a 90 day entry from a non-b visa. Your more than likely have an extension of stay based upon working issued by immigration.

1. If your new employer would apply for a work permit and obtain a work permit approval letter you could could cancel your current extension of stay with a termination letter your old employer and apply for new one with supporting documents from and the work permit approval letter from your new employer.

Not sure why you new employer is telling you apply for a new non-b visa you home country. You could apply for one at a nearby country unless you are form a country that can only apply for visa in you home country.

2. You need to complete a tax return from any income earned last year by March 31st. You will probably will get a refund of any taxes deducted by your employer prior to January 1st.

Thanks mate. I'm from India and last time when the new company applied for a non B visa for another Indian, it got rejected twice. Finally he applied himself in India and got it. So the new company asking me to apply from India. 

 

2) you mean if my company dint pay the remaining 6 months tax (because they dint pay me salary) should I pay my tax amount * 6 times?? How to deal with this.?

You only have to pay tax on reported income which is only done when they have deducted the taxes from your pay.

Your new employer in the scenario I mentioned would not be applying for a visa for you at immigration. It would be a new extension of stay application after the one you apparently have now is canceled.

Thank you. Yes my new employer just give me a invitation letter and I have to go with it to India and apply there for 3 months non B visa. Once I am here they, company will extend to 1 year.  About Tax I think it's clear from your side. I'm checking with the old employer now for tax certificate. One more thing is, if I cancel my work permit and visa how long can I stay here?

Only until midnight on the day you do it unless you apply for an extension, pay 1900 baht and be granted 7 days to leave the country after it is denied.
