Residents of luxury condo want action as foreigners allowed to stay on daily rent

I remember the days when foreigners would stay daily/weekly, etc. So many would just hang around the gym or pool all day taking up space. They weren't badly behaved, but they were treating the place like a resort. Whereas when us owners use the pool and gym, etc, we get in and we get out. Let other people use the facilities. 

 

Glad to see them gone. 

 

in my upscale 99% thai owner condo the locals spend time in the gym and usually just sit on the machines checking the internet on phone thus blocking machines for others to use. despite clear signs in thai and english to turn off aircon when finished they almost never do. most locals dont like the pool but i do and often use it like it were a resort. the very concept of a condo is to provide occupants with a resort like facility.

    Read your condo rules, most follow the Hotel Law that forbids condo rentals for less than 30 days. It is not nonsense but a security issue.

It is - but that doesn't mean you hang around the pool and gym all day every day. Most people have jobs and/or other things to do. Not so much daily or weekly renters who are making the most of having a pool and gym at their doorstep. 

 

Thus my point that I like my condo cracked down on it. I want my place of residence to feel first and foremost like a home. Not a hotel.

Fit a movement sensor for a few hundred Baht.

Most of you lot have got it wrong.

The law was passed as Members of the Hotel Assoc agreed to pay a "bed tax" which was imposed on all Hotels as it is in many countries around the world (before you start your Thai bashing.)

In return for them agreeing the Govt of the day passed a law that apartments, condos & houses did not rent for less than one month occupancy which to me is perfectly reasonable.

There is no law that states that your friends, relatives cannot stay in your property as long as there is no financial consideration

You might need a couple. Any competent technician should know what would be needed.

 

The other option would be a push-button timer that gave, for example, 30 minutes use for one push. Put the lights on it too.

i can and i do sometimes. owners and renters guests do also. it is their right as it is mine

I know people who own houses here and who seem to live in their pools, day and night. Some people are like that. Up to them. Personally I dont like pools at all but that's just me.

That would depend on where the condo is. Your management should know about local suppliers as they probably already have similar things in other parts of the building. CCTV people and automation people would know about it too.

A bit confusing in the case where one has members of family coming from far away places to stay in ones condo without paying any rent. View that there are many cases where the members of a thai family of a wife or girl friend are considered as members of family for the foreigner.

If this is actually included in the condominium rules then I wonder why they have not acted on it?  Why go to the Police?  If the condo owners have not voted on this rule then get it done and get on with it.  If it’s just a threat then why would anyone follow it if their interest is best served by not following the threat?

The Chinese sites don't have the same regulations as AirBnB exactly but they are aware of the month or longer rule.

 

As another poster guessed (quite correctly) if anyone turns up, they can show a monthly contract but are maybe only staying a few days. If asked rentor and landlord will just cite family emergency and quick return home. Another rentor will probably arrive the same day. There's nothing ilegal on paper but the system is easy to circumvent, particularly when there's no common language. Who's going to translate the contract?

 

 

that's where photographic/video evidence plus notification to immigration comes handy..

In the block where I live there are never any problems. Airbnb rules and reviews makes sure everyone behaves respectfully.

The anti-Airbnb campaign is led by big chain hotel owners, often foreign shareholders, so no interest in Thailand or Thai people. They just want tourist income for themselves.

more bs. airbnb guests are usually an asshat tourist that disturbs everyone with their selfish behavior.

It is more than likely any family members coming to stay would have a modicum of respect compared to a day renter looking to party. They probably won't be bringing drunk hookers home at 3am to wake up real residents of the building.

I am on my condo's committee. If an owner refuses to pay, after discussions, we can shut off water and electricity. For long term non payers (often people who have disappeared for years or passed away) we file a court case. Once awarded rights to recover losses, we can sell the condo.  Of course, committee members are also owners and have a degree of compassion. In a condo, it's not a good idea not threaten your neighbours.

If you want to avoid the tourists, you need to pay for that luxury. 250,000 baht/month is what I pay to live at 98 Wireless Rd. You won't find any tourists at 98 Wireless. If tourists from the West can afford the rent at your condo, tough luck, deal with it. We live in an Uber/AirBnB world and there is nothing anyone can do to stop it. It's only going to get worse as the singularity approaches.

my condo building,at cosy beach, is tough on 'short term renters'...its very good that way...

i have units either side of mine, that are rented out,one annualy..these tenants never cause me any problems...

i think the buildings that have MANY  unsold condos, are the main users of BNB  rentals..trying to get any return they can,on their 'investment'.

my building threatens to turn off power,water and key card access, to any short term renters.also reporting the owner to thai revenue dept and immo...

Nothing to do with property rights a condo owner only owns a share of the juristic person. The hotel act prohibits short term rentals. Immigration has cracked down on TM30 all over.

Even if Thai authorities didn't care, short term AbnB guests WILL NOT behave as residents They are not living they are holidaying.  If only they would follow a few simple common sense rules, not make noise and leave filth in the halls to attract vermin it would not be a problem. Illiminating it is an ongoing issue here at my place for the typical reasons.

 

BTW I have encountered mainland Chinese tourists in large numbers in 3 different countries, always the same screaming and slamming doors at 5AM in the morning it is some kind of innate tendency for them not what people want in a luxury condo.

Yes.

If it says 30 days under the condo rules then this is the law. You don't have the right to rent it out under this time frame.

If you are overseas and not there to personally take someone into your property, I can see that. 

 

I fail to see how it is enforceable though when an owner escorts renters to a property, airbnb or not. 

Juristic person can always check upon whether anybody is leasing out short stay on Airbnb by checking the website. Make a booking and nab the unit owner if unit is on rental in Airbnb.
