Hello guys,

 

In between jobs and previous work permit and the 1 year extension of stay were properly cancelled and same day applied for 60 day spouse visit extension which ends on May 31 Friday. So I am technically still on the original Non-B visa.

 

New school has already arranged teacher's license waiver and I have signed the document pack for WP application. I am also going to get medical certificate tomorrow morning so they can apply for work permit. But since my extension of stay ends on May 31, can you please confirm that a receipt of WP application is adequate (along with all other required docs) to stamp in the new extension of stay based on employment? This way after submitting WP application we can head over to Immigration to sort out new extension.

A work permit application receipt is not going to cut it. The work permit must be issued before you can submit the application for extension based on the work permit. However, I believe the work permit can be issued same day, if everything is in place.

Just looked up, my previous WP was issued on Oct 22 and 1yr extension stamped in on the 23rd - I stand corrected. I remembered otherwise...

 

Yes, everything is in place or at least will be by tomorrow. I hope're right about how fast they may be able to issue the WP. The not too composed HR rep told me 1 month which seems absurd. (The person handling these left recently so I guess that may not be accurate.) Thanks!

If you have an extension, your original visa is not valid anymore and you will be on overstay.

That is nonsense. A single entry Non-B is used up as soon as you have entered the Kingdom. From that point on you have 90 days to secure work permit and based on that immigration grants a one year extension of stay. Which can then be extended again for a year upon continuous employment and so on. The reason for extension, however, can change and that is the case here. @ubonjoe mentioned before that it could be possible in this particular case. I still have 2 weeks to get new WP (all paperwork will be in order today) and based on that a new extension of stay.

What I meant was that I didn't have to leave the country upon previous wp/extension of stay cancellation because I applied for family visit 60 day extension same day on the basis of marriage.

@ubonjoe can I please ask for your help here? Today my HR went to Phuket employment office and the desk clerk said that WP application cannot be submitted because my 60 day family visit extension rendered the original Non-B entry into a tourist visa (???) or invalid (not sure what she remembered, but that was the essence of it) which is of course not the case. Do you know where I could look up the corresponding regulation which proves that:

  1. The 60 day extension I made after having the previous WP and 1 yr extension of stay cancelled, is indeed the extension of the original Non-B visa I'd entered on ie. it did not change and
  2. I am allowed to apply for a work permit and subsequently a new extension of stay during this period.

Any help would me much appreciated. I've got until 31th Friday to sort this out or else I'll have to go to Savannakhet for a spouse visa which I'd hate to do. Also thinking of hiring a lawyer locally as a last resort if his/her quote costs less than the visa trip.

1. They are certainly wrong when saying that the 60 day extension changed it to a tourist visa. You extended your original entry from a non-b visa for 60 days.

2. Yes you can since you extended your non-b visa entry.

I think the problem is the office you are dealing with is notorious for making up their own rules.

You could show this clause of the police order 327/2557 but not sure it would help. And your marriage certificate.

Thanks for the update, will look into it. Will also go to immigration where they issued the 60 day extension and ask them to liaise with employment office to reiterate that I am indeed on the extension of the original non B entry.

 

Have also emailed a local law office, ILO - see what they have to say.
