German Visa

Featured Replies

Thai woman (living in Phuket) with German fiance (living in Stuttgart). He is coming to BKK in June to marry her, but she wants to already have a German visa whens he arrives so they can go to Germany soon after the wedding. Should she apply for a tourist visa (only good for 90 days) and they apply for resident visa after she gets to Germany, or should she apply for resident visa initially (before she is married)? She is also 7 months pregnant...will her baby automatically be included under her passport/visa or is there a separate document needed? Can she apply by courier to the German consulate in BKK or must she apply in person?

Thanks

Children cannot be included on a parents passport in Thailand so before she can do anything she must get a passport for herself and the child. From Phuket it is probably easiest to go to Song Khla (see Passport Offices Thailand ) and take the necessary documents .

If the father is named on the birth certificate she will need ID from the father and their marriage certificate.

If the father is not named on the birth certificate then it will be virtually impossible for the child to get a German passport in the future

After that she can think about which Visa is best, by which time I would think her fiancee will be in Thailand to help

unfortunately you can't apply for a german residence visa from abroad. the simple reason is that no such visa exists. a normal visitor visa is sufficient to apply in Germany for the residence permit (initially granted for three years when married to a german citizen).

it would be very helpful to have the marriage registered at the german embassy in Bangkok and obtain a consularized copy of the marriage certificate (if possible in english or german) for the german authorities to facilitate the residence permit.

I don't know but it may be easier to marry in Germany then the papers are all in German and no certification is needed. You could still have the temple blessing here but register here.

Regarding the baby as the baby will be born in Thailand the child will have a Thai birth certificate and I would check with the German embassy on obtaining a german certificate.

I know that for Brits you get it at the esbassy aslong with the childs British passport.

Also the father will have to report the birth to the German Embassy in BKK or if there is a consultate maybe the consulte in Hull as required by Section 4, paragraph 4 of the Nationality Act - StAG :

If a notice of the birth is submitted by the German parents or parent to the competent mission of the Federal Republic of Germany within one year.

He many also be able to get a passport for the child at the same time removing the need for a german visa. But there are some quite complex laws on dual nationality and I suggest that the Herr Porsche have a look at http://www.auswaertiges-amt.de/diplo/en/La...chliessung.html and help his future wife.
